Primary Industries Legislation Further Amendment Act 2009

The Parliament of Victoria enacts:

1Purpose

The main purpose of this Act is to amend the Primary Industries Legislation Amendment Act 2009 to change the dates of operation of various provisions of that Act.

2Commencement

This Act comes into operation on the day on which it receives the Royal Assent.

3Changes to commencement provision

(1)In section 2(1) of the Primary Industries Legislation Amendment Act 2009 omit "and Division 1 of Part 5".

(2)Section 2(2) of the Primary Industries Legislation Amendment Act 2009 is repealed.

(3)In section 2(5) of the Primary Industries Legislation Amendment Act 2009, for "1 December 2009" substitute "31 December 2010".

(4)In section 2(6) of the Primary Industries Legislation Amendment Act 2009, for "2008" substitute "2010".

(5)After section 2(6) of the Primary Industries Legislation Amendment Act 2009 insert—

"(7)This Act is deemed to have been enacted as amended by the Primary Industries Legislation Further Amendment Act 2009.".

4Amendments to section 46

(1)In section 46 of the Primary Industries Legislation Amendment Act 2009, in proposed new section 163B of the Fisheries Act 1995, for "1 January 2009" (wherever occurring) substitute "the commencement day".

(2)In section 46 of the Primary Industries Legislation Amendment Act 2009, after proposed new section 163B(5) of the Fisheries Act 1995 insert—

"(6)In this section commencement day means the date of commencement of Division 1 of Part 5 of the Primary Industries Legislation Amendment Act 2009.".

5Amendments to section 100

In section 100 of the Primary Industries Legislation Amendment Act 2009—

(a)for "94B or" substitute "94B, 95(1), 95A(1) or";

(b)for "94B, 96B" substitute "94B, 95(1), 95A(1), 96B".

6Amendment to section 121

In section 121 of the Primary Industries Legislation Amendment Act 2009, for "1 December 2010" substitute "31 December 2011".

7Repeal of amending Act

This Act is repealed on the first anniversary of its commencement.

Note

The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
