Human Tissue Amendment Act 2009

No. 47 of 2009

[Assented to 18 August 2009]

The Parliament of Victoria enacts:

1Purpose

The main purpose of this Act is to amend the Human Tissue Act 1982 to enable persons who have attained the age of 16 or 17 years to consent to donate blood without their parent's consent.

2Commencement

This Act comes into operation on the day after the day on which it receives the Royal Assent.

3New section 20A inserted

After section 20 of the Human Tissue Act 1982 insert

"20A   Definition of child for the purposes of sections 21, 22 and 23

For the purposes of sections 21, 22 and 23, child means a person who has not attained the age of 16 years.".

4Repeal of amending Act

This Act is repealed on the first anniversary of its commencement.

Note

The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
