Water Amendment (Non Water User Limit) Act 2009

The Parliament of Victoria enacts:

1Purpose

The purpose of this Act is to amend the Water Act 1989 to remove the non water user limit, a legislative cap on the volume of water shares that can be owned if those water shares are not associated with a parcel of land. 

2Commencement

This Act comes into operation on the day after the day on which it receives the Royal Assent.

3Principal Act

In this Act, the Water Act 1989 is called the Principal Act.

4Definitions

(1)In section 3(1) of the Principal Act, the definition of non water user limit is repealed.

(2)Section 3(4) of the Principal Act is repealed.

5Circumstances in which Minister must not issue a share

Section 33I(1) of the Principal Act is repealed.

6Ministerial approval

Section 33X(2) of the Principal Act is repealed.

7Cancellation where interstate rights are obtained

Section 33AB(2) of the Principal Act is repealed.

8Revocation of associated water share determination on application

Section 33AP(2) of the Principal Act is repealed.

9Repeal of heading to Division 11 of Part 3A

The heading to Division 11 of Part 3A of the Principal Act is repealed.

10Repeal of section 33AR

Section 33AR of the Principal Act is repealed.

11Obligations for water share owners on cessation of ownership or occupation of land

Sections 33AS(2), 33AS(3) and 33AS(4) of the Principal Act are repealed.

12Repeal of sections 33AT and 33AU

Sections 33AT and 33AU of the Principal Act are repealed.

13Application for Tribunal to review certain decisions of Minister as to water shares

In section 33AX(d) of the Principal Act omit ", unless the refusal is under section 33X(2)".

14Statute law revision

In section 33F(1) of the Principal Act, for "Minister, may" substitute "Minister may".

15Repeal of amending Act

This Act is repealed on the first anniversary of its commencement.
