Planning and Environment Amendment (Schools) Act 2012

The Parliament of Victoria enacts:

1Purpose

The purpose of this Act is to amend the Planning and Environment Act 1987 to provide that subdivisions of, and building work relating to, land used or to be used for schools will not give rise to liability to pay growth areas infrastructure contributions.

2Commencement

This Act comes into operation on the day after the day on which it receives the Royal Assent.

3Definitions in Part 9B

In section 201R of the Planning and Environment Act 1987 insert the following definitions—

"construction has the meaning that it has in the Building Act 1993;

school has the same meaning as in section 1.1.3 of the Education and Training Reform Act 2006;".

4Excluded subdivisions of land

After section 201RF(b) of the Planning and Environment Act 1987 insert

"(ba)the purpose of the subdivision is solely to provide a lot for a school or a proposed school; or".

5Excluded building work

After section 201RG(1)(c) of the Planning and Environment Act 1987 insert

"(ca)building work relating to a school or proposed school including purposes ancillary to a school; or".

6Repeal of amending Act

This Act is repealed on the first anniversary of its commencement.

Note

The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
