Tobacco Amendment (Shopper Loyalty Schemes) Act 2012
No. 86 of 2012

The Parliament of Victoria enacts:
1Purpose
The purpose of this Act is to amend the Tobacco Act 1987 to limit further the operation of shopper loyalty schemes in relation to the sale of tobacco products.
2Commencement
(1)Subject to subsection (2), this Act comes into operation on a day to be proclaimed.
(2)If this Act does not come into operation before 1 March 2013, it comes into operation on that day.
3Competitions, rewards and shopper loyalty schemes
(1)Insert the following heading to section 7 of the Tobacco Act 1987—
"Competitions, rewards and shopper loyalty schemes".
(2)For section 7(2) of the Tobacco Act 1987 substitute—
"(2)In proceedings for an offence against subsection (1), it is a defence to prove that it was not practicable for the person to identify the purchased item that gave rise to the supply of the benefit or thing or participation in the scheme as a tobacco product.".
4Repeal of amending Act
This Act is repealed on 1 March 2014.
Note
The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the Interpretation of Legislation Act 1984).
