1  Name

This is the List of Exempt Native Specimens Instrument 2001.

2  Authority

This instrument is made under subsection 303DB(1) of the Environment Protection and Biodiversity Conservation Act 1999.

3  Definitions

In this instrument:

EPBC Act means the Environment Protection and Biodiversity Conservation Act 1999.

list means the list established by section 4.

personal baggage means personal baggage (including personal effects) of a person departing from Australia that is not intended to be used for any commercial purpose, including sale, lease, hire or exchange.

4  Establishment of the list

(1)  The list in Schedule 1 is established for the purposes of subsection 303DB(1) of the EPBC Act.

(2)  This is a list of native specimens that are exempt from export control under the EPBC Act (see Part 13A of that Act).

(3)  The list includes only specimens that are, or are derived from, Australian native animals and plants.

(4)  The list does not include live mammals, birds, reptiles or amphibians.

5  How the list works

Taxon/Item column

(1)  Items in the column of the list headed “Taxon / Item” may:

(a)  include the scientific names of taxa related to the items; or

(b)  include descriptions that uniquely identify fisheries the specimens from which are included on the list.

Common name and Taxon/Item columns

(2)  The column of the list headed “Common Name” is included for information only, and in particular:

(a)  if a common name specified for an item in the column of the list headed “Common name” is that of an animal or a plant—the scientific name in the column of the list headed “Taxon / Item” for that item determines if specimens of the species so named are included on the list; and

(b)  if a common name specified for an item in the column of the list headed “Common name” is that of a fishery—the description of the fishery in the column of the list headed “Taxon / Item” for that item determines if specimens from the fishery described are included on the list.

(3)  Inclusion of a specimen in the list is subject to any conditions or restrictions included for the specimen in the column of the list headed “Notation”.

Note:          A specimen must satisfy any such conditions or restrictions in order to be exempt from export control under the EPBC Act (see Part 13A of that Act).

7  Automatic repeal of spent items

This section repeals an item in the list, with effect from the start of a particular day (the repeal day), if the item provides in the column of the list headed “Notation” that:

(a)  the item, or the specimen (or specimens) covered by the item, is included in (or on) the list until the day before the repeal day; or

(b)  the inclusion of the item, or the specimen (or specimens) covered by the item, in (or on) the list is to expire after a specified period that ends on the day before the repeal day.

Specimens that are or are derived from fish or invertebrates, other than specimens that belong to species listed under Part 13 of the EPBC Act (other than a species listed in the conservation dependent category) and specimens that belong to taxa listed under section 303CA of the EPBC Act (Australia’s CITES list), produced in aquaculture facilities operating in Victoria in accordance with the Fisheries Act 1995 (VIC) and subordinate legislation. Approved aquaculture programs in Victoria The specimen, or the fish or invertebrate from which it is derived, was taken lawfully; and
The specimens are included in the list until 30 November 2028.
Specimens that are or are derived from fish or invertebrates, other than specimens that belong to species listed under Part 13 of the EPBC Act (other than a species listed in the conservation dependent category) and specimens that belong to taxa listed under section 303CA of the EPBC Act (Australia’s CITES list), produced in aquaculture facilities operating in Western Australia in accordance with the Fish Resources Management Act 1994 (WA) and subordinate legislation. Approved aquaculture programs in Western Australia The specimen, or the fish or invertebrate from which it is derived, was taken lawfully; and
The specimens are included in the list until 30 November 2028.
Marine specimen shells taken in Western Australian waters by licenced operators under the Fish Resources Management Act 1994; The specimen, or the fish or invertebrate from which it is derived, was taken lawfully; and
The specimens are taken while the declaration of an approved Wildlife Trade Operation under section 303FN of the Act in relation to the fishery is in force.
Specimens that are or are derived from fish, aquatic invertebrates or aquatic plants that are produced lawfully in an aquaculture facility that has been licensed by the relevant State or Territory government agency, other than specimens that are or belong to species listed on CITES or under Part 13 of the Environment Protection and Biodiversity Conservation Act 1999. The operation does not involve the introduction of wild caught/collected specimens, including parental stock, and is limited to specimens bred within the operation.
The operation is conducted in a manner such that specimens of the species in production cannot enter from the wild or escape into the wild from the operation.
Fisheries

Australia’s High Seas Permits

·     The specimen, or the fish or invertebrate from which it is derived, was taken lawfully;

·     The specimens are included in the list until 9 October 2026.

Specimens that are or are derived from fish or invertebrates, other than specimens that belong to species listed under Part 13 of the EPBC Act, taken in the Bass Strait Central Zone Scallop Fishery, as defined in the Bass Strait Central Zone Scallop Fishery Management Plan 2002, in force under the Commonwealth Fisheries Management Act 1991. Bass Strait Central Zone Scallop Fishery The specimen, or the fish or invertebrate from which it is derived, was taken lawfully;
The specimens are included in the list until 9 October 2026.

Specimens that are or are derived from fish or invertebrates, taken by Australian flagged vessels authorised under permits issued under the Fisheries Management Act 1991 (Cth) to operate in the Ross Sea Exploratory Toothfish Fishery in Subareas 88.1 and 88.2 of the Commission for the Conservation of Antarctic Marine Living Resources (CCAMLR) Convention Area, but not including:

·     specimens that belong to eligible listed threatened species, as defined under section 303BC of the EPBC Act, or

·     specimens that belong to taxa listed under section 303CA of the EPBC Act (Australia’s CITES List).

CCAMLR Ross Sea Exploratory Toothfish Fishery

·     the specimen, or the fish or invertebrate from which it is derived, was taken lawfully;

·     the specimens are included in the list until 27 November 2020.

Specimens that are or are derived from fish or invertebrates, other than specimens that belong to species listed under Part 13 of the EPBC Act (other than a species listed in the conservation dependent category), and specimens that belong to taxa listed under section 303CA of the EPBC Act (Australia’s CITES list), taken in the Commonwealth Coral Sea Fishery as defined in the management regime in force under the Fisheries Management Act 1991 (Cth) and the Fisheries Management Regulations 1992 (Cth). Commonwealth Coral Sea Fishery The specimen, or the fish or invertebrate from which it is derived, was taken lawfully, and
The specimens are covered by the declaration of an approved wildlife trade operation under section 303FN of the EPBC Act in relation to the fishery.

Specimens that are or are derived from fish or invertebrates taken in the Commonwealth Eastern Tuna and Billfish Fishery as defined in the Eastern Tuna and Billfish Fishery Management Plan 2010 made under the Fisheries Management Act 1991 (Cth), but not including:

·     specimens that belong to eligible listed threatened species, as defined under section 303BC of the EPBC Act, or

·     specimens that belong to taxa listed under section 303CA of the EPBC Act (Australia’s CITES List).

Commonwealth Eastern Tuna and Billfish Fishery

·     the specimen, or the fish or invertebrate from which it is derived, was taken lawfully;

·     the specimens are covered by the declaration of an approved wildlife trade operation under section 303FN of the EPBC Act in relation to the fishery.

Specimens that are or are derived from fish or invertebrates, other than specimens that belong to species listed under Part 13 of the EPBC Act, taken under permit in the Commonwealth Informally Managed Fishing Permits. Commonwealth Informally Managed Fishing Permits The specimen, or the fish or invertebrate from which it is derived, was taken lawfully;
The specimens are covered by the declaration of an approved Wildlife Trade Operation under section 303FN of the EPBC Act in relation to the fishery.

Specimens that are or are derived from fish or invertebrates taken in the Commonwealth Northern Prawn Fishery as defined in the Northern Prawn Fishery Management Plan 1995 in force under the Fisheries Management Act 1991 (Cth) and Fisheries Management Regulations 1992 (Cth), but not including:

·    specimens that belong to eligible listed threatened species, as defined under section 303BC of the EPBC Act, or

·    specimens that belong to taxa listed under section 303CA of the EPBC Act (Australia’s CITES List).

Commonwealth Northern Prawn Fishery

·    the specimen, or the fish or invertebrate from which it is derived, was taken lawfully;

·    the specimens are included in the list until 06 January 2024.

Specimens that are or are derived from fish or invertebrates taken in the Commonwealth Small Pelagic Fishery as defined in the Small Pelagic Fishery Management Plan 2009 made under the Fisheries Management Act 1991 (Cth), but not including:

·     specimens that belong to eligible listed threatened species, as defined under section 303BC of the EPBC Act, or

·     specimens that belong to taxa listed under section 303CA of the EPBC Act (Australia’s CITES List).

Commonwealth Small Pelagic Fishery

·     the specimen, or the fish or invertebrate from which it is derived, was taken lawfully;

·     the specimens are included in the list until 21 October 2023.

Specimens that are or are derived from fish or invertebrates taken in the Commonwealth Southern and Eastern Scalefish and Shark Fishery as defined in the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003 made under the Fisheries Management Act 1991 (Cth) and Fisheries Management Regulations 1992 (Cth), but not including:

·    specimens that belong to eligible listed threatened species, as defined under section 303BC of the EPBC Act, or

·    specimens that belong to taxa listed under section 303CA of the EPBC Act (Australia’s CITES List).

Commonwealth Southern and Eastern Scalefish and Shark Fishery

·    the specimen, or the fish or invertebrate from which it is derived, was taken lawfully;

·    the specimens are covered by the declaration of an approved wildlife trade operation under section 303FN of the EPBC Act in relation to the fishery.

Specimens that are or are derived from fish or invertebrates, other than specimens that belong to species listed under Part 13 of the EPBC Act (other than a species listed in the conservation dependent category), and specimens that belong to taxa listed under section 303CA of the EPBC Act (Australia’s CITES list), taken in the Commonwealth Western Deepwater Trawl and North West Slope Trawl Fisheries as defined in the management regime in force under the Fisheries Management Act 1991 (Cth) and the Fisheries Management Regulations 1992 (Cth). New South Wales Estuary General Fishery The specimen, or the fish or invertebrate from which it is derived, was taken lawfully, and

Specimens that are or are derived from fish or invertebrates taken in the New South Wales Estuary Prawn Trawl Fishery as defined in the management regime in force under the Fisheries Management Act 1994 (NSW), the Fisheries Management (Estuary Prawn Trawl Share Management Plan) Regulation 2006 (NSW), and the Fisheries Management (General) Regulation 2010 (NSW), but not including:

·    specimens that belong to eligible listed threatened species, as defined under section 303BC of the EPBC Act, or

·    specimens that belong to taxa listed under section 303CA of the EPBC Act (Australia’s CITES List).

New South Wales Estuary Prawn Trawl Fishery

·      the specimen, or the fish or invertebrate from which it is derived, was taken lawfully; and

·      the specimens are included in the list until 31 March 2028.

Specimens that are or are derived from fish or invertebrates taken in the New South Wales Lobster Fishery, but not including:

(a)    specimens that belong to eligible listed threatened species, as defined under section 303BC of the EPBC Act, or

(b)   specimens that belong to taxa listed under section 303CA of the EPBC Act (Australia’s CITES List).

New South Wales Lobster Fishery The specimen, or the fish or invertebrate from which it is derived, was taken lawfully, and
