Road Safety (Vehicles) (Miscellaneous Fees)

Regulations 2003

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to amend the increase certain fees in respect of vehicles.

2. Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3. Commencement

These Regulations come into operation on 1 July
2003.

4.  Exemption from transfer fees—vehicles designed for use by incapacitated persons

In regulation 237(2) of the Road Safety (Vehicles)

Regulations 19991—

(a) in paragraph (a), for "13 or 14" substitute "13, 13A, 13B or 14";
(b) in paragraphs (b) and (c), after "13," insert "13A, 13B,".

5. Increase in recreation motor cycle registration fees In item 2 in the Table to Schedule 4 to the Road Safety (Vehicles) Regulations 1999, for "$6.50" substitute "$7.00".

6. Revocation of redundant items

In the Table to Schedule 4 to the Road Safety
(Vehicles) Regulations 1999, items 7 and 8 are
revoked.

7. Vehicles designed for use by incapacitated persons After item 13 in the Table to Schedule 4 to the Road Safety (Vehicles) Regulations 1999 insert—

"13A. Private vehicle used to convey incapacitated person

A vehicle registered or to be registered in the name of—

(a) an incapacitated person; or

(b)

the parent or legal guardian of an incapacitated person who is a minor—

if the vehicle—

(c)

is specially converted to provide wheelchair access to and egress from the vehicle; and

(d)

is capable of carrying at least one occupied wheelchair; and

(e)

is or is to be used for conveying an incapacitated person whose mobility is seriously impaired; and

(f)

is not a taxi-cab within the meaning of the Transport Act 1983 nil

13B. Government or charitable vehicle used to convey

incapacitated person

A vehicle registered or to be registered in the name of—

(a)

a charitable, benevolent or religious institution; or

(b) the Crown; or

(c) a public statutory authority; or

(d)

a Council within the meaning of the Local Government Act 1989—

if the vehicle—

(e) is specially converted to provide wheelchair access to and egress from the vehicle; and
(f) is capable of carrying at least one occupied wheelchair; and
(g) is or is to be used for conveying an incapacitated person whose mobility is seriously impaired; and
(h) is marked with the name of the registered operator or, in the case of the Crown, with the name of the relevant department or agency; and

(i) is not a taxi-cab within the meaning of the Transport Act 1983 nil".

8. Increase in search and extract fees

In Schedule 5 to the Road Safety (Vehicles)

Regulations 1999—

(a) in item 1, for "$7.00" substitute "$7.20";

(b) in item 2, for "$7.00" substitute "$7.20";

(c) in item 3, for "$13.00" substitute "$13.30";

(d) in item 4, for "$7.00" substitute "$7.20";

(e) in item 5(i), for "$7.00" substitute "$7.20";

(f)

9. Increase in certain miscellaneous fees

In Schedule 6 to the Road Safety (Vehicles)

Regulations 1999—

(a) in item 1, for "375.00" substitute "386.00";

(b) in item 2, for "84.00" substitute "87.00";

(c) in item 3, for "12.50" substitute "13.00";

(d) in item 4, for "10.00" substitute "10.30";

(e) in item 6, for "16.50" substitute "17.00";

(f) in item 7, for "78.00" substitute "80.00";

(g) in item 8, for "32.00" substitute "33.00";

(h) in item 9, for "31.50" substitute "32.00";
