Chattel Securities Act 1987

Chattel Securities (Fees) Regulations 2003

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to amend the certain fees and to replace redundant provisions.

2. Authorising provisions

These Regulations are made under sections 3(7),

12 and 28 of the Chattel Securities Act 1987.

3. Commencement

These Regulations come into operation on 1 July

2003.

4. Substitution of regulation 6

For regulation 6 of the Chattel Securities

Regulations 19971 substitute—

"6. Prescribed purchase price amount

The purchase price prescribed for the purposes of section 7 is—

(a)	$20 000 for a purchase or purported purchase made on or after 1 August 1987 and before 1 January 1998;
(b)	$30 000 for a purchase or purported purchase made on or after 1 January 1998.".

5. Substitution of regulation 7

For regulation 7 of the Chattel Securities

Regulations 1997 substitute—

"7. Fees for applications

The fee payable to the Corporation for an application to register a security interest under section 16 of the Act is—

(a) in the case of an application on-line and in batch—

(i)  if the application was made before 1 July 2003, $5.60;

(ii)  if the application is made on or after 1 July 2003, $6.00; and

(b) in the case of an application on a magnetic tape—

(i)  if the application was made before 1 July 2003, $5.70;

(ii)  if the application is made on or after 1 July 2003, $6.00; and

(c) in any other case—

(i)  if the application was made before 1 July 2003, $10.20;

(ii)  if the application is made on or after 1 July 2003, $10.50.".

6. Increase in fees for certificates

For regulation 10(1) of the Chattel Securities

Regulations 1997 substitute—

"(1) The fee payable in respect of an application

under section 24(1) of the Act is—

(a) if the customer has an account with the Corporation—

(i)  if the application was made before 1 July 2003, $6.40;

(ii)  if the application is made on or after 1 July 2003, $7.00; and

(b) in any other case—

(i)  if the application was made before 1 July 2003, $7.50;

(ii)  if the application is made on or after 1 July 2003, $8.00.".

7. Revocation of regulation 12

Regulation 12 of the Chattel Securities

Regulations 1997 is revoked.
