2003

The Governor in Council makes the following Order:

1. Objective

The objective of this Order is to increase fees in the County Court (Court Fees) Order 2001.

2. Authorising provision

This Order is made under section 28 of the

County Court Act 1958.

3. Commencement

This Order comes into operation on 16 June 2003.

4. Increased fees

For the Table in Schedule 2 of the County Court

(Court Fees) Order 20011 substitute—

"FEES

FILING ORIGINATING PROCESS

1	For filing originating process	$433.00
2	For issuing an originating adoption summons	$185.00
3	For filing an application for the approval of a
proposed change of name of a child under section
36(4) of the Births, Deaths and Marriages
Registration Act 1996	$185.00
4	On transfer of a proceeding from the Magistrates'	$433 less any
Court	fee paid to the Magistrates' Court on commencement of the proceeding
FILING OTHER PROCESS
5	For filing a counterclaim, defence and counterclaim,

or third party notice under Order 11 $433.00

6	For filing an interlocutory application	$191.00
7	For filing an application for the examination of a
judgment debtor under Rule 67.02 or 72.04 or a
summons for oral examination under Rule 61.04 of
Chapter I of the Rules of the County Court	$129.00
8	For filing material for an ex-parte order	$103.00
9	For filing a subpoena	$62.00
10	For every application by a judgment creditor under
section 6 or 8 of the Judgment Debt Recovery Act
1984 or for the filing by a judgment creditor of an
instalment agreement under section 7 of that Act	$36.00
SETTING DOWN FEES
11	On setting down for trial	$433.00
HEARING FEES
12	For hearing at trial by Judge or Judge with jury—for
every day or part of a day (except that where a fee
has been paid under item 9 no fee is payable for the
first day or first part of that day)	$227.00

13        For each sitting of the Registrar taxing costs

(otherwise than on a judgment by default or consent)
taking accounts or evidence, making enquiries or
acting as a special examiner—

for every hour or part of an hour $155.00

14        For every sitting of an officer of the Court at

mediation—

for each hour or part of an hour $62.00

15        For each sitting of an officer of the Court at pre-trial

conference $62.00

ENTERING JUDGMENTS OR ORDERS

16        For filing judgment in default of appearance or

pleading or judgment obtained under Order 22, 23 or

24 of Chapter I of the Rules of the County Court $144.00

REGISTRY ACTIVITIES

17 For every certificate of the Registrar $31.00

18        For every search of documents not otherwise

provided for, or of registers or suitors' books, for each

month or part of a month requested to be searched $19.00

19        Copies of Judges Notes or office copies of any

proceedings whatever, each page $7.00

20        For registrar fixing date and time of sitting for taxing

costs $51.00
21	Production of a file to another Court or Tribunal $103.00".
