Firearms Act 1996

Firearms (Handgun Control) Regulations 2003

The Governor in Council makes the following Regulations:

1. Objectives

The objectives of these Regulations are to amend the Firearms Regulations 1997—

(a)

to prescribe approved handgun target shooting matches; and

(b)

to prescribe reasons for which the Chief Commissioner cannot issue a general category handgun licence; and

(c)

to prescribe fees for the issue and renewal of licences and permits and for other matters; and

(d)

to prescribe classes of social workers and professional counsellors for the purposes of section 183 of the Firearms Act 1996; and

(e)

to make various consequential amendments to the regulations.

2. Authorising provision

These Regulations are made under section 191 of the Firearms Act 1996.

3. Commencement

(1) These Regulations, other than regulations 14, 15,

16, 17, 18, 19 and 20, come into operation on
1 July 2003.

(2) Regulations 14, 15, 16, 17, 18, 19 and 20 come into operation on 30 December 2003.

4. Principal Regulations

In these Regulations the Firearms Regulations

19971 are called the Principal Regulations.

5. Substitution in regulation 11

In regulation 11 of the Principal Regulations, for

"$15" substitute "$16".

6. Substitution in regulation 13

In regulation 13 of the Principal Regulations, for ", the fee for a permit to acquire a firearm is $8" substitute "the fee for a permit to acquire a

firearm is $9".

7. Insertion of new regulation 17A

After regulation 17 of the Principal Regulations insert—

"17A. Reason for which the Chief Commissioner

must not issue a General Category
Handgun Licence

For the purposes of section 17(d) of the Act, if a person has relinquished a handgun licence and has received compensation for the surrender of the handguns held under that licence, the Chief Commissioner must not issue a general category handgun licence to that person for a period of five years from

the date of that relinquishment and

surrender.".

8. Insertion of new regulations 19A, 19B and 19C

After regulation 19 of the Principal Regulations insert—

'19A. Prescribed approved handgun target

shooting matches for general category

handguns of ·38 inch calibre or less

For the purposes of the definition of
"approved handgun target shooting match" in
section 3(1) of the Act, the classes of
approved handgun target shooting matches
for general category handguns of ·38 inch
calibre or less are those described in

Schedule 7.

19B. Prescribed approved handgun target

shooting matches for general category
handguns of more than ·38 inch calibre but
not more than ·45 inch calibre

For the purposes of the definition of "approved handgun target shooting match" in section 3(1) of the Act, the classes of approved handgun target shooting matches for general category handguns of more than ·38 inch calibre but not more than ·45 inch calibre are those described in Schedule 8.

19C. Approved handgun target shooting matches

for general category handguns of more
than ·45 inch calibre

For the purposes of the definition of
"approved handgun target shooting match" in
section 3(1) of the Act, the classes of
approved handgun target shooting matches

9. Substitution in regulation 20

(1) Insert the following heading to regulation 20 of

the Principal Regulations—
"Prescribed purposes for applying for longarm
and general category handgun licences".

(2) In regulation 20(4) of the Principal Regulations,

for "handgun" (wherever occurring) substitute
"general category handgun".

10. Insertion of new regulation 22

After regulation 21 of the Principal Regulations insert—

"22. Prescribed classes of social worker

For the purposes of section 183(4) of the prescribed—

a person who is a member of, or who is
eligible for membership of, the
Australian Association of Social

Workers.".

11. Substitution of Schedule 4

For Schedule 4 to the Principal Regulations substitute—

13. Insertion of new Schedules 7, 8 and 9

After Schedule 6 to the Principal Regulations insert—

'SCHEDULE 7

CLASSES OF APPROVED HANDGUN TARGET SHOOTING MATCHES FOR HANDGUNS OF A

CALIBRE OF ·38 INCH OR LESS

1.

The match shot with an air pistol at a distance of up to which is conducted in a manner accredited by the International Shooting Sport Federation and which is known as "Air Pistol" in the handgun shooting discipline known as International Shooting Sport Federation (ISSF).

2.       The match shot with a handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary when exposed, which is conducted in a

manner accredited by the International Shooting Sport Federation and which is known as "Standard Pistol" in the handgun shooting discipline known as International Shooting Sport Federation (ISSF).

3.       The match shot with a centre fire handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary when exposed, which is

conducted in a manner accredited by the International
Shooting Sport Federation and which is known as
"Centre Fire Pistol" in the handgun shooting discipline
known as International Shooting Sport Federation
(ISSF).

4.       The match shot with a handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary when exposed, which is conducted in a

manner accredited by the International Shooting Sport
Federation and which is known as "Rapid Fire Pistol" in
the handgun shooting discipline known as International
Shooting Sport Federation (ISSF).

5.       The match shot with a handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary when exposed, which is conducted in a

manner accredited by the International Shooting Sport Federation and which is known as "50 Metre Pistol" in the handgun shooting discipline known as International Shooting Sport Federation (ISSF).

6.       The match shot with a handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary when exposed, which is conducted in a

manner accredited by the International Shooting Sport Federation and which is known as "25 Metre Pistol" in the handgun shooting discipline known as International Shooting Sport Federation (ISSF).

7.       A match shot with a handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary or moving in the target area when exposed, which is conducted in a manner accredited by the International Practical Shooting Confederation and which is known as "Open Division" in the handgun shooting discipline known as International Practical Shooting Confederation.

8.       A match shot with a handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary or moving in the target area when exposed, which is conducted in a manner accredited by the International Practical Shooting Confederation and which is known as "Standard Division" in the handgun shooting discipline known as International Practical Shooting Confederation.

9.       A match shot with a handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary or moving in the target area when exposed, which is conducted in a manner accredited by the International Practical Shooting Confederation and which is known as "Modified Division" in the handgun

shooting discipline known as International Practical
Shooting Confederation.

10.     A match shot with a handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary or moving in the target area when exposed, which is conducted in a manner accredited by the International Practical Shooting Confederation and which is known as "Production Division" in the handgun shooting discipline known as International Practical Shooting Confederation.

11.     A match shot with a revolver of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary or moving in the target area when exposed, which is conducted in a manner accredited by the International Practical Shooting Confederation and which is known as "Revolver Division" in the handgun shooting discipline known as International Practical Shooting Confederation.

12.     The match shot with a handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary when exposed, which is conducted in a

manner accredited by the National Referee Council for
Pistol Australia and which is known as "International
Rapid Fire" in the handgun shooting discipline known as
International 1920 Match (or NRA Action Match).

13.     The match shot with a handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary when exposed, which is conducted in a

manner accredited by the National Referee Council for Pistol Australia and which is known as "Barricade" in the handgun shooting discipline known as International

1920 Match (or NRA Action Match).

14.     The match shot with a handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that moves across the target area when exposed, which is conducted in a manner accredited by the National Referee Council for Pistol Australia and which is known as "Moving Target (Modified)" in the handgun shooting discipline known as International 1920 Match (or NRA Action Match).

15.     The match shot with a revolver or semi-automatic handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary when exposed, which is conducted in a manner accredited by the National Referee Council for Pistol Australia and which is known as "Falling Plate" in the handgun shooting discipline known as International 1920 Match (or NRA Action Match).

16.     The match shot with a revolver or semi-automatic handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary when exposed, which is conducted in a manner accredited by the National Referee Council for Pistol Australia and which is known as "Practical Event" in the handgun shooting discipline known as International 1920 Match (or NRA Action Match).

17.     The match shot with a single shot handgun, revolver or semi-automatic handgun of a calibre of ·38 inch or less at a distance of up to 200 metres at a target that is

stationary when exposed, which is conducted in a
manner accredited by the National Referee Council for
Pistol Australia and which is known as "Big Bore" in the
handgun shooting discipline known as Metallic
Silhouette.

18.     The match shot with a single shot handgun, revolver or semi-automatic handgun of a calibre of ·38 inch or less at a distance of up to 100 metres at a target that is

stationary when exposed, which is conducted in a
manner accredited by the National Referee Council for
Pistol Australia and which is known as "Small Bore" in
the handgun shooting discipline known as Metallic
Silhouette.

19.     The match shot with a single shot handgun, revolver or semi-automatic handgun of a calibre of ·38 inch or less at a distance of up to 25 metres at a target that is

stationary when exposed, which is conducted in a
manner accredited by the National Referee Council for
Pistol Australia and which is known as "Air Pistol" in
the handgun shooting discipline known as Metallic
Silhouette.

20.     The match shot with a single shot handgun, revolver or semi-automatic handgun of a calibre of ·38 inch or less at a distance of up to 100 metres at a target that is

stationary when exposed, which is conducted in a
manner accredited by the National Referee Council for
Pistol Australia and which is known as "Field Pistol" in
the handgun shooting discipline known as Metallic
Silhouette.
21.

The match shot with two revolvers of a calibre of target that is either stationary or moving when exposed, which is conducted in a manner consistent with the Rules as accredited by the Single Action Shooting Society and as administered in Australia by SSAA Single Action Shooting Australia and which is known as "One Match" in the handgun target shooting discipline known as Single Action.

22.     The match shot with a revolver or semi-automatic handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary when exposed, which is conducted in a manner accredited by the National Referee Council for Pistol Australia and which is known as "Service Pistol" in the handgun shooting discipline known as Service Pistol.

23.     The match shot with a centre fire revolver or semi- automatic handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary when exposed, which is conducted in a manner accredited by the National Referee Council for Pistol Australia and which is known as "Service Pistol Unrestricted" in the handgun shooting discipline known as Service Pistol.

24.     The match shot with a revolver or semi-automatic handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary when exposed, which is conducted in a manner accredited by the National Referee Council for Pistol Australia and which is known as "Police and Service Pistol" in the handgun shooting discipline known as Service Pistol.

25.     The match shot with a revolver or semi-automatic handgun of a calibre of ·38 inch or less at a distance of up to 50 metres at a target that is stationary when exposed, which is conducted in a manner accredited by the National Referee Council for Pistol Australia and

MATCHES FOR HANDGUNS OF A CALIBRE OF

MORE THAN ·45 INCH

1.       A black powder match shot using a pistol or revolver fired by percussion caps with a calibre of more than ·45 inch at a distance of 25 metres at a stationary target,

which is conducted in a manner accredited by the known as "25 Metre" in the handgun shooting discipline known as Black Powder.

2.       A black powder match shot using a pistol or revolver fired by percussion caps with a calibre of more than ·45 inch at a distance of 25 metres at a stationary target,

which is conducted in a manner accredited by the known as "25 Metre" in the handgun shooting discipline known as Black Powder.'.

14. Substitution in regulation 11

In regulation 11 of the Principal Regulations, for

"$16" substitute "$15".

15. Substitution in regulation 13

In regulation 13 of the Principal Regulations, for "the fee for a permit to acquire a firearm is $9" substitute ", the fee for a permit to acquire a firearm is $8".

16. Revocation of regulation 17A

Regulation 17A of the Principal Regulations is revoked.

17. Revocation of regulations 19A, 19B and 19C

Regulations 19A, 19B and 19C of the Principal
Regulations are revoked.

20. Revocation of Schedules 7, 8 and 9

Schedules 7, 8 and 9 to the Principal Regulations are revoked.
