1. Objectives

n The objectives of these Regulations are to—
a (a) prescribe standards of energy efficiency and
n performance for certain fluorescent lamp
o
ti ballasts;
la (b) provide for the registration of those
is fluorescent lamp ballasts;
g (c) regulate the labelling of those fluorescent
e lamp ballasts;

(d) make miscellaneous and consequential

n amendments.

ri 2. Authorising provisions
to These Regulations are made under sections 154
ic and 157 of the Electricity Safety Act 1998.

3. Commencement

These Regulations come into operation 5 days

ts after the day on which they are made.
n 4. Principal Regulations

In these Regulations, the Electricity Safety

(Equipment Efficiency) Regulations 1999 are

c called the Principal Regulations.
o 5. Revocation of regulation 4

Regulation 4 of the Principal Regulations is

ry revoked.
ta 6. Definitions

e In regulation 5(1) of the Principal Regulations,
m insert the following definitions—
ia ' "AS/NZS 4783.1:2001" means
rl AS/NZS 4783.1:2001 as referred to in
a Schedule 3 and amended from time to time;
P "AS/NZS 4783.2:2002" means
d AS/NZS 4783.2:2002 as referred to in
n Schedule 3 and amended from time to time;
a
n "registrable fluorescent lamp ballast" means a
o ballast of the type referred to in clause 6.4.1
ti of AS/NZS 4783.2:2002;'.
la 7. Minimum standards for energy efficiency and

g (1) After regulation 6(1) of the Principal Regulations

n "(1A) Sub-regulation (1) does not apply to

ri registrable fluorescent lamp ballasts.".

(2) After regulation 6(5) of the Principal Regulations

insert—

ts "(6) Registrable fluorescent lamp ballasts must
n comply with—
e (a) the performance criteria set out in
m clause 6.2 of AS/NZS 4783.2:2002
u when tested in accordance with
c AS/NZS 4783.1:2001 by a laboratory
o accredited by the National Association
D of Testing Authorities or approved by
ry the Office; and
ta (b) the minimum energy performance
n standards set out in clause 6.4.1 of
e AS/NZS 4783.2:2002 when tested in
m accordance with AS/NZS 4783.1:2001
ia by a laboratory accredited by the
rl National Association of Testing
a Authorities or approved by the Office;

d (c) in the case of a ballast labelled with an
n energy efficiency index classification of
a A1, the requirements set out in
n clause 5.3.2 of AS/NZS 4783.2:2002
o
ti when tested in accordance with
AS/NZS 4783.1:2001 by a laboratory
la accredited by the National Association

n Before regulation 7 of the Principal Regulations

"6A. Proclaimed electrical equipment not

9. Applications for registration

(1) After regulation 8(2) of the Principal Regulations

ts insert—
n "(2A) Sub-regulation (2) does not apply to
e registrable fluorescent lamp ballasts.".
m (2) After regulation 8(3C) of the Principal
u
c Regulations insert—
o "(3D) An application for the registration of a
D registrable fluorescent lamp ballast must—
ry (a) be made in accordance with the
ta requirements for an application for
n registration set out in section 7 of
e AS/NZS 4783.2:2002; and
m (b) be in the form set out in Appendix A of
ia AS/NZS 4783.2:2002; and
rl (c) specify whether the equipment
a

complies with the performance criteria and the minimum energy performance

d standards prescribed in regulation 6(6);
n
a and
n (d) be accompanied by—
o
ti (i) the results of testing referred to in

regulation 6(6) in the form set out

la in Appendix G of AS/NZS
is 4783.1:2001; and
g
e (ii) a likeness of the electrical
L equipment label to be printed on
n the equipment; and
a
ri (iii) the relevant fee set out in

Schedule 2.".

10. Requirements for registration or transfer

(1) After regulation 11(b) of the Principal Regulations

ts insert—
n
e "(ba) in the case of registrable fluorescent lamp

ballasts—

m

u (i) the equipment complies with the
c requirements of regulation 6(6); and
o
D (ii) the electrical equipment label complies

with the requirements of regulation

ry 16(4)(a);".
ta (2) In regulation 11(c)(iii) of the Principal
n Regulations, for "6(5)." substitute "6(5);".
e

(3) At the end of regulation 11 of the Principal

Regulations insert—

"(2) Sub-regulation (1)(a) does not apply to

P 11. Cancellation of registration

n In regulation 13(1)(a) of the Principal

12. Electrical equipment labels

After regulation 16(3) of the Principal Regulations

ts insert—
n "(4) For the purposes of section 68 of the Act, an
e electrical equipment label for a registrable
m fluorescent lamp ballast must—
u
c (a) state the energy efficiency index
o classification of the ballast determined
D in accordance with clause 5.3.1 of
ry AS/NZS 4783.2:2002; and
ta (b) be in accordance with the requirements

of clause 5.4.1 of AS/NZS

n

e 4783.2:2002; and

(c) not be attached in such a manner that

m

the label is obscured; and

(d) not contain any words, figures or

a symbols that mislead or are likely to
P mislead with respect to the energy
d efficiency index classification or
n performance characteristics of the
a ballast.".
n 13. Offer of supply

ti After regulation 17(2) of the Principal Regulations

is "(3) This regulation does not apply to registrable
g fluorescent lamp ballasts.".
