Health (Infectious Diseases) (Amendment) Regulations 2004

The Governor in Council makes the following Regulations:

1.Objective

The objective of these Regulations is to make further provision for infectious diseases.

2.Authorising provisions

These Regulations are made under sections 146, 390(1) and 391 of the Health Act 1958.

3.Commencement

These Regulations come into operation on 30 January 2004.

4.Principal Regulations

In these Regulations, the Health (Infectious Diseases) Regulations 2001[1] are called the Principal Regulations.

5.Definitions

In regulation 22 of the Principal Regulations, for "this Part" substitute "this Division and Division 2".

6.New Division 3 of Part 5 inserted

After Division 2 of Part 5 of the Principal Regulations insert

"Division 3—Provision of Information

25A.Information to clients of skin penetration premises

(1)The proprietor of a business that provides tattooing, ear piercing, acupuncture or any other process involving the penetration of the skin in a living human being must ensure, before such a process is provided to a person, that written information is provided directly to the person about the transmission of infectious diseases associated with the process.

Penalty:20 penalty units.

(2)A proprietor of a business that provides tattooing, ear piercing, acupuncture or any other process involving the penetration of the skin in a living human being must take reasonable steps to ensure that the information about the transmission of infectious diseases provided to a person under sub-regulation (1) is medically accurate.

Penalty:20 penalty units.

(3)This regulation does not apply to—

(a)a business that is prescribed as an exempt business by regulation 5 of the Health (Exempt Businesses) Regulations 2000[2]; or

(b)the practice of acupuncture of—

(i)a person registered as an acupuncturist under the Chinese Medicine Registration Act 2000; or

(ii)a person authorised in accordance with section 61(11) of that Act.".

7.Infectious disease

In Schedule 2 to the Principal Regulations, in the list of items headed "Diseases or conditions caused by viral infections", after the item "Rubella—including congenital rubella" insert "Severe Acute Respiratory Syndrome (SARS)".

8.Notifiable diseases

(1)In Schedule 3 to the Principal Regulations, in Group A, after "Rabies" insert

"Severe Acute Respiratory Syndrome (SARS)

Smallpox

Tularaemia".

(2)In Schedule 3 to the Principal Regulations, in Group B—

(a)after "Campylobacter infection" insert "Creutzfeldt-Jakob disease (CJD)";

(b)after "Mumps" insert "Mycobacterium ulcerans";

(c)after "Tuberculosis" insert "variant Creutzfeldt-Jakob disease (vCJD)".

9.Exclusion of cases of SARS from schools and children's services centres

In Schedule 6 to the Principal Regulations, after the item relating to "Salmonella, Shigella"

(a)in column 1, insert "Severe Acute Respiratory Syndrome (SARS)";

(b)in column 2, insert "Exclude until medical certificate of recovery is produced";

(c)in column 3, insert "Not excluded unless considered necessary by the Secretary".

10.Exclusion of cases of VTEC from schools and children's services centres

In Schedule 6 to the Principal Regulations, after the item relating to "Typhoid fever (including paratyphoid fever)"

(a)in column 1, insert "Verotoxin producing Escherichia coli (VTEC)";

(b)in column 2, insert "Exclude if required by the Secretary and only for the period specified by the Secretary";

(c)in column 3, insert "Not excluded".
