Transport Act 1983

Transport (Infringements) (Amendment) Regulations 2004

The Governor in Council makes the following Regulations:

1.Objective

The objective of these Regulations is to amend the Transport (Infringements) Regulations 1999 to make further provision for infringements under the Transport Act 1983.

2.Authorising provisions

These Regulations are made under sections 215(1) and 215G of the Transport Act 1983.

3.Principal Regulations

In these Regulations, the Transport (Infringements) Regulations 1999[1] are called the Principal Regulations.

4.Amendment of objectives

In regulation 101 of the Principal Regulations—

(a)in paragraph (e), for "penalties." substitute "penalties; and";

(b)after paragraph (e) insert

"(f)any other matter required, permitted or necessary to be prescribed by the Act.".

5.Amendment to definition

In regulation 104 of the Principal Regulations, in the definition of "authorised officer" for "Division 2" substitute "Division 1".

6.Ticket infringements

In regulation 201 of the Principal Regulations—

(a)in Column 3 of the first item of the Table, after "T.A. s. 221(4A)" insert "or s. 221AA(2)";

(b)in Column 2 of the last item of the Table, for "Unable to produce valid ticket while making journey" substitute "Unable to produce valid ticket";

(c)in Column 3 of the last item of the Table after "T.A. s. 221(4)" insert "or s. 221AA(2)".

7.Form of infringement notice

In regulation 205(2)(j) of the Principal Regulations, after "signature" insert "or name".

8.New regulation 210 inserted

After regulation 209 of the Principal Regulations insert

"210.Administrative costs payable in respect of certain ticket infringements

For the purposes of section 213A of the Transport Act 1983

(a)administrative costs may be paid to a passenger transport or bus company in respect of ticket infringements referred to in that section;

(b)the administrative costs permitted to be paid to a passenger transport or bus company are $20 for each infringement notice issued for a ticket infringement referred to in that section that relates to a carriage operated by or on behalf of the company or land or premises owned, occupied or controlled by the company.".
