Victorian Civil and Administrative Tribunal (Fees) (Amendment) Regulations 2004

The Governor in Council makes the following Regulations:

1.  Objective

The objective of these Regulations is to amend the Victorian Civil and Administrative Tribunal (Fees) Regulations 2001 by—

(a)decreasing the fee payable for the commencement of proceedings under the Domestic Building Contracts Act 1995 where the amount sought is under $10 000; and

(b)prescribing the fee payable for the commencement of certain proceedings under the Fair Trading Act 1999.

2.  Authorising provision

These Regulations are made under section 161 of the Victorian Civil and Administrative Tribunal Act 1998.

3.  Commencement

These Regulations come into operation on 1 July 2004.

4.Fees

In the Table to regulation 4 of the Victorian Civil and Administrative Tribunal (Fees) Regulations 2001[1], in Part A—

(a)after item 2(2)(b) insert

"(ba)Domestic Building Contracts Act 1995 (where the amount sought is under $10 000);";

(b)for item 4(t) substitute

"(t)Domestic Building Contracts Act 1995 where the amount sought is $10 000 or more, but is less than $100 000;";

(c)for item 4(zd) substitute

"(zd)Fair Trading Act 1999 where the claim is
$10 000 or more, but is less than $100 000;".
