Intellectually Disabled Persons' Services (Fees) Regulations 2004

The Governor in Council makes the following Regulations:

1.Objective

The objective of these Regulations is to amend the Intellectually Disabled Persons' Services Regulations 1997 to increase the scale of fees payable for accommodation or care of or for services rendered to eligible persons resident in a residential institution or a residential program operated by the Department.

2.Authorising provision

These Regulations are made under section 78 of the Intellectually Disabled Persons' Services Act 1986.

3.Commencement

These Regulations come into operation on 1 September 2004.

4.Principal Regulations

In these Regulations, the Intellectually Disabled Persons' Services Regulations 1997[1] are called the Principal Regulations.

5.Definition of community residential unit

In regulation 4 of the Principal Regulations, the definition of "community residential unit" is revoked.

6.Fees

For regulation 10 of the Principal Regulations substitute

"10.Fees for accommodation, care or services

(1)An eligible person must pay the applicable fee set out in Table 1 of Schedule 3 if that person resides in, and is provided with care or services at, accommodation that is—

(a)a residential institution operated by the Department; or

(b)a residential program operated by the Department at an address listed in Schedule 4.

(2)An eligible person must pay the applicable fee set out in Table 2 of Schedule 3 if that person resides in accommodation that is a residential program operated by the Department, other than a residential program at an address listed in Schedule 4.

(3)An eligible person must pay the applicable fee set out in Table 3 of Schedule 3 if that person, for respite purposes, resides overnight or for any intermittent period in accommodation that is a residential program operated by the Department.".

7.Schedule 3 substituted and new Schedule 4 inserted

For Schedule 3 of the Principal Regulations substitute
