Transport (Passengers and Rail Freight) (Amendment) Regulations 2004
The Governor in Council makes the following Regulations:

1.Objective
The objective of these Regulations is to regulate the carrying of open containers of intoxicating liquor on public transport.
2.Authorising provisions
These Regulations are made under sections 56, 215 and 249B of the Transport Act 1983.
3.Commencement
These Regulations come into operation on 1 November 2004.
4.No possession of open container of intoxicating liquor
At the end of regulation 317 of the Transport (Passengers and Rail Freight) Regulations 1994[1] insert—
"(2)A person must not be in possession of an open container of intoxicating liquor in or on any rail or road vehicle or any rail premises unless the liquor has been purchased from, and is consumed at, a place that has been authorised by a passenger transport company, a rail freight operator or Rail Track for that purpose.
Penalty:10 penalty units.".
5.Consequential amendmentTransport (Infringements) Regulations 1999—
In the Table at the foot of regulation 202 of the Transport (Infringements) Regulations 1999[2], in Column 3 of the entry relating to Code 3144, for "PRFR r. 317" substitute "PRFR r. 317(1)".
