Road Safety (General) (Amendment) Regulations 2004
The Governor in Council makes the following Regulations:

1. Objective
The objective of these Regulations is to amend the Road Safety (General) Regulations 1999 to prescribe procedures for obtaining evidence in relation to the speed and location of vehicles for the operation of cameras that are capable of operating in a speed mode or a red light mode.
2.Authorising provision
These Regulations are made under section 95 of the Road Safety Act 1986.
3.Principal Regulations
In these Regulations, the Road Safety (General) Regulations 1999[1] are called the Principal Regulations.
4.Definition
For the definition of "digital file" in regulation 105 of the Principal Regulations substitute—
' "digital file" means a file in a digital format, or electronic copy of such a file, which is created by a control unit and contains—
(a)digital images; and
(b)data indicating the date on which, and the time and place at which, the image was captured by a camera; and
(c)if the digital file is relevant to an offence of exceeding a speed limit, data indicating—
(i)the speed limit at that time and place; and
(ii)the speed of the vehicle to which the digital image relates; and
(d)if the digital image is relevant to an offence of disobeying a traffic control signal, data indicating the length of time for which that traffic control signal had been red; and
(e)the checksum for that file;'.
5.Automatic detection devices
In regulation 303(c)(iv) of the Principal Regulations, after "removable storage media" insert ", if any,".
6.Prescribed processes
(1)For regulation 313(1)(c)(ii) and (iii) of the Principal Regulations substitute—
"(ii)if the printed image is relevant to an offence of exceeding a speed limit, the speed limit at the time and place at which the vehicle was driven and the speed at which the vehicle was driven; and
(iii)if the printed image is relevant to an offence of disobeying a traffic control signal, the length of time for which that traffic control signal had been red.".
(2)For regulation 313(2)(b)(ii) and (iii) of the Principal Regulations substitute—
"(ii)if the digital file is relevant to an offence of exceeding a speed limit—
(A)the speed limit at the time and place at which the vehicle was driven; and
(B)the speed at which the vehicle to which the image relates was driven, as transmitted to the control unit from the speed calculation unit; and
(iii)if the digital file is relevant to an offence of disobeying a traffic control signal, the length of time for which that traffic control signal had been red; and".
