Fisheries (Consequential Amendments) Regulations 2004

The Governor in Council makes the following Regulations:

1.Objectives

The objectives of these Regulations are to—

(a)make consequential changes to references to certain Aquaculture licences;

(b)correct a reference to a class of Aquaculture licence in Schedule 12.

2.Authorising provision

These Regulations are made under section 153 of the Fisheries Act1995.

3.Principal Regulations

In these regulations, the Fisheries Regulations 1998[1] are called the Principal Regulations.

4.Consequential amendments

In the Principal Regulations—

(a)in regulation 203(l) for "Licence;" substitute "Licence.";

(b)insert the following heading to regulation 617A—

"Levy for Aquaculture (Crown Land—Bivalve Shellfish) Licence for the Victorian Shellfish Quality Assurance Program";

(c)in regulations 617A(4) and 617A(7) for "Aquaculture (Crown Land) Type A Licence" substitute "Aquaculture (Crown Land—Bivalve Shellfish) Licence";

(d)in regulation 617A(5) for "Aquaculture (Crown Land) Type A Licences" (wherever occurring) substitute "Aquaculture (Crown Land—Bivalve Shellfish) Licences";

(e)in Schedule 15 after "119B" insert ";".

5.Correction to reference in Table A to Schedule 12

In Table A to Schedule 12 of the Principal Regulations, in column 2 of item 36 for "Aquaculture (Crown Land) Licence" substitute "Aquaculture (Crown Land—Other) Licence".

6.Revocation of ineffective provisions

Regulations 23(1) and 23(3) of the Fisheries (Miscellaneous Amendments) Regulations 2004[2] are revoked.
