Conservation, Forests and Lands (Infringement Notice) (Amendment) Regulations 2005

The Lieutenant-Governor as the Governor's Deputy with the advice of the Executive Council makes the following Regulations:

1.Objective

The objective of these Regulations is to amend Schedule 2 to the Conservation, Forests and Lands (Infringement Notice) Regulations 2002 to prescribe—

(a)further offences against a relevant law for which an infringement notice may be served; and

(b)penalties for those offences.

2.Authorising provision

These Regulations are made under section 99 of the Conservation, Forests and Lands Act 1987.

3.Commencement

These Regulations come into operation on 1 July 2005.

4.Prescribed offences and penalties

(1)In Schedule 2 to the Conservation, Forests and Lands (Infringement Notice) Regulations 2002[1], after item 104 insert

"104A 6861 An offence under regulation 13(1)(b) of the Forests (You Yangs Regional Park) Regulations 2003 1 penalty unit carry, use or discharge any firearm, long bow or cross bow in the You Yangs Regional Park".

(2)In Schedule 2 to the Conservation, Forests and Lands (Infringement Notice) Regulations 2002, after item 208 insert

"208A 6862 An offence under regulation 16(2) of the Wildlife (State Game Reserve) Regulations 2004 1 penalty unit enter into or remain in a prohibited access area
208B 6863 An offence under regulation 16(3) of the Wildlife (State Game Reserve) Regulations 2004 1 penalty unit enter into or remain in a restricted access area".

(3)In Schedule 2 to the Conservation, Forests and Lands (Infringement Notice) Regulations 2002, after item 212 insert

"212AA

An offence under regulation 21(2) of the Wildlife (State Game Reserve) Regulations 2004

1 penalty unit

construct a blind or hide in a prohibited or restricted area

An offence under regulation 21(3) of the Wildlife (State Game Reserve) Regulations 2004

fail to construct a blind or hide in a reserve as required by regulation 21(3) of the Wildlife (State Game Reserve) Regulations 2004
