Public Administration (Reviews) (Amendment) Regulations 2005

The Governor in Council makes the following Regulations:

1.Objective

The objective of these Regulations is to amend the Public Administration (Reviews) Regulations 2005 to alter the minimum period that can be specified for the lodging by an employee of an application for initial review of a proposed appointment or promotion.

2.Authorising provisions

These Regulations are made under sections 64 and 112 of the Public Administration Act 2004.

3.Initial review process

(1)In regulation 5(2)(b) of the Public Administration (Reviews) Regulations 2005[1], omit "(being not less than 28 days)".

(2)After regulation 5(2) of the Public Administration (Reviews) Regulations 2005 insert

"(3)The period specified under sub-regulation (2)(b) must not be less than—

(a)7 days if the action to which the application relates is a proposed appointment or promotion; or

(b)28 days in any other case.".
