Private Agents Act 1966

Private Agents (Amendment) Regulations 2005

The Governor in Council makes the following Regulations:

1.  Objective

The objective of these Regulations is to amend the Private Agents Regulations 2003—

(a)to revoke provisions relating to security licences; and

(b)to change references from registrar to Chief Commissioner.

2.  Authorising provisions

These Regulations are made under sections 4(2) and 51 of the Private Agents Act 1966.

3.  Commencement

These Regulations come into operation on 1 July 2005.

4.  Regulation 4 substituted

For regulation 4 of the Private Agents Regulations 2003[1] substitute

'4.Definition

In these Regulations—

"the Act" means the Private Agents Act 1966.'.

5.  Exemptions

In regulation 5 of the Private Agent Regulations 2003—

(a)in paragraph (a)(ii), for "debts;" substitute "debts.";

(b)paragraphs (b) and (c) are revoked.

6.Duties and functions of the Chief Commissioner

(1)In the heading to regulation 7 of the Private Agents Regulations 2003, for "registrar" substitute "Chief Commissioner".

(2)In regulation 7 of the Private Agents Regulations 2003—

(a)for "registrar" (wherever occurring) substitute "Chief Commissioner";

(b)in sub-regulation (1), for "register; and" substitute "register.";

(c)in sub-regulation (1), paragraphs (d) and (e) are revoked.

7.Revocation of regulations relating to security licences

Regulations 9, 10, 12, 13, 15, 16(4), 16(5) and Part 3 of the Private Agents Regulations 2003 are revoked.

8.Offence for commercial agent not to record within 7 days

In regulation 17 of the Private Agents Regulations 2003, for "specified private agent referred to in section 44A of the Act" substitute "commercial agent".

9.Regulation 18 substituted

For regulation 18 of the Private Agents Regulations 2003 substitute

"18.Inspection of records

A person required to keep a record under section 44A of the Act must make the record available for inspection at any time during normal business hours by any member of the police force.".

10.Offence to obstruct during inspection

In regulation 19 of the Private Agents Regulations 2003 omit "the registrar or".

11.References to Chief Commissioner

In regulations 30(b) and 34 of the Private Agents Regulations 2003, for "registrar" (wherever occurring) substitute "Chief Commissioner".

12.Amendments to Schedule

In the Schedule to the Private Agents Regulations 2003—

(a)in clause 4(b) in Form 1 omit "if a commercial agent,";

(b)Forms 2 and 3 are revoked.
