Road Safety (General) (Speed Measuring Devices) Regulations 2005

The Lieutenant-Governor as the Governor's Deputy with the advice of the Executive Council makes the following Regulations:

1.Objective

The objective of these Regulations is to amend the Road Safety (General) Regulations 1999 to—

(a)prescribe additional detection devices that are capable of operating to detect offences of exceeding a speed limit or disobeying a traffic control signal that is red or both;

(b)simplify the prescribed process for production of an image or message for the purposes of sections 80(b), 80A, 81(1)(c) and 81(2) of the Road Safety Act 1986.

2.Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3.Principal Regulations

In these Regulations, the Road Safety (General) Regulations 1999[1] are called the Principal Regulations.

4.Definitions

In regulation 105 of the Principal Regulations—

(a)in the definition of "control unit", for "or (i)" substitute ", (i), (j) or (k)";

(b)for the definition of "digital file" substitute—

' "digital file" means a file in a digital format, or electronic copy of such a file, which is created by a control unit and contains—

(a)one or more digital images; and

(b)data indicating the date on which, and the time and place at which, the image was captured by a camera; and

(c)the checksum for that file;';

(c)in the definition of "speed calculation unit", for "or (i)" substitute ", (i), (j) or (k)";

(d)in the definition of "vehicle detectors", for "or (i)" substitute ", (i), (j) or (k)".

5.Automatic detection devices

In regulation 302 of the Principal Regulations—

(a)in paragraph (i), for "system." substitute "system; and";

(b)after paragraph (i) insert—

"(j)the automatic detection device known as the REDFLEXred-speed HDX system; and

(k)the automatic detection device known as the REDFLEXlasercam FDSC.".

6.Use of automatic detection devices

In regulation 303(c) of the Principal Regulations, for "or (i)" substitute ", (i), (j) or (k)".

7.Prescribed speed measuring devices

In regulation 305(a) of the Principal Regulations, for "or (i)" substitute ", (i), (j) or (k)".

8.Testing of speed measuring devices

In regulation 306(b)(i) of the Principal Regulations, for "or (i)" substitute ", (i), (j) or (k)".

9.Sealing of speed measuring devices

In regulation 307(a) of the Principal Regulations, for "or (i)" substitute ", (i), (j) or (k)".

10.Process for production of printed image

(1)In regulation 313(1) of the Principal Regulations—

(a)in paragraph (a), omit "by the processes set out in sub-regulation (2)";

(b)in paragraph (b)(i), after "checksum" insert "produced by the control unit".

(2)Regulation 313(2) of the Principal Regulations is revoked.
