Melbourne City Link Act 1995
Melbourne City Link (General) (Amendment) Regulations 2005
The Governor in Council makes the following Regulations:

1.Objective
The objective of these Regulations is to amend the Melbourne City Link (General) Regulations 1999—
(a)to include additional sensor units and tags as prescribed tolling devices; and
(b)to remove the requirement for a sensor unit to be positioned on a gantry; and
(c)to revise references to certain sections of the Melbourne City Link Act 1995.
2.Authorising provision
These Regulations are made under section 118 of the Melbourne City Link Act 1995.
3.Definitions
In regulation 103 of the Melbourne City Link (General) Regulations 1999[1]—
(a)for the definition of "sensor unit" substitute—
' "sensor unit" means—
(a)the device known as the Vehicle Registration Sensor Unit Type TS 4240/00A which is also referred to as Model Number TS 4240/00A;
(b)the device known as the Vehicle Registration Sensor Unit Part Number 8633 001-415;';
(b)for the definition of "tag" substitute—
' "tag" means a vehicle transponder known as a Tag (Model Number TS 3204/00A, TS 3204/01A, TS 3204/02A or TS 3204/02B);'.
4.Use of sensor unit
In regulation 402(a) of the Melbourne City Link (General) Regulations 1999 omit "on a gantry in the mountings provided for the unit".
5.New Part 6 substituted
For Part 6 of the Melbourne City Link (General) Regulations 1999 substitute—
'PART 6—MISCELLANEOUS
601.Definition of enforcement agency with respect to certain functions
For the purposes of the definition of "enforcement agency" in section 3 of the Act, the enforcement agency is the Secretary to the Department of Justice with respect to the enforcement agency's functions under—
(a)section 77(1)(b) of the Act, except sub-paragraphs (ii) and (iii); and
(b)section 78(1) of the Act.'.
