Magistrates' Court Act 1989

Magistrates' Court Civil Procedure (Amendment No. 14) Rules 2005

The Chief Magistrate together with 2 Deputy Chief Magistrates jointly make the following Rules:

1.Object

The object of these Rules is to substitute a new definition of "solicitor" in the Magistrates' Court Civil Procedure Rules 1999 and to—

(a)increase various items; and

(b)revoke a note to an item—

in the Scale of Costs in Appendix A to those Rules.

2.Authorising provision

These Rules are made under section 16 of the Magistrates' Court Act 1989 and all other enabling powers.

3.Commencement

These Rules come into operation on 1 January 2006.

4.Substitution of definition

In Rule 1.10(1) of the Magistrates' Court Civil Procedure Rules 1999[1], for the definition of "solicitor" substitute—

' "solicitor" means an Australian lawyer as defined in the Legal Profession Act 2004, other than a barrister as defined in that Act, and includes an incorporated legal practice as defined in that Act;'.

5.Amendments to Appendix A

In Appendix A to the Magistrates' Court Civil Procedure Rules 1999, in the Scale of Costs—

(a)in item 1—

(i)in paragraph (a), for "142" substitute "147";

(ii)in paragraph (b), for "296" substitute "307";

(iii)in paragraph (c), for "364" substitute "377";

(iv)in paragraph (d), for "435" substitute "451";

(v)in paragraph (e), for "543" substitute "562";

(vi)in paragraph (f) , for "653" substitute "676";

(vii)in paragraph (g), for "781" substitute "809";

(b)the note at the foot of item 57 is revoked;

(c)in item 79—

(i) for "55 cents" substitute "60 cents";

(ii)in Note B, for "55 cents" substitute "60 cents";

(d)in item 82—
