Transport (Rail Safety) (Amendment) Regulations 2005
The Lieutenant-Governor, having assumed the administration of the government of the State, with the advice of the Executive Council, makes the following Regulations:

1.Objective
The objective of these Regulations is to amend the Transport (Rail Safety) Regulations 1998 to—
(a)facilitate national uniformity by changing—
(i)the date by when accreditation fees are to be paid; and
(ii)the way in which certain accreditation fees are calculated for the purposes of Division 3 of Part VI of the Transport Act 1983; and
(b)amend the accreditation fee payable by certain providers of rolling stock who maintain rolling stock.
2.Authorising provision
These Regulations are made under section 129Y of the Transport Act 1983.
3.Commencement
These Regulations come into operation on 1 January 2006.
4.Change of date by when accreditation fees are to be paid
For regulation 6(d) of the Transport (Rail Safety) Regulations 1998[1] substitute—
"(d)pay the relevant annual accreditation fee set out in the Schedule—
(i)within 7 days of the issue of the Certificate of Accreditation; and
(ii)before 30 September of every year after the year in which the Certificate of Accreditation was issued.".
5.Change in, and the method of calculation of, certain accreditation fees
(1)In the Schedule to the Transport (Rail Safety) Regulations 1998, for item 3(c)(i)(A) and (B) substitute—
"(A)for accreditation as an operator of rolling stock, an amount of $0.019 for each kilometre travelled by each freight train operated by the person in Victoria during the previous financial year;
(B)for accreditation as an operator of rolling stock, an amount of $0.010 for each kilometre travelled by each passenger train, or tramway car (including light rail vehicle) operated by the person in Victoria during the previous financial year;".
(2)In the Schedule to the Transport (Rail Safety) Regulations 1998, for item 3(c)(i)(D) substitute—
"(D)for accreditation as a provider of rolling stock, an amount of 500 fee units for all rolling stock maintained by the person on a scheduled basis (that is excluding maintenance activities associated with the examination of trains or tramway cars (including light rail vehicles), the preparation of trains or tramway cars (including light rail vehicles), or minor defect rectification on trains or tramway cars (including light rail vehicles)) within Victoria;".
6.Minor consequential amendments
(1)In the Schedule to the Transport (Rail Safety) Regulations 1998, in item 3(c)(ii), for "those amounts" substitute "the amounts referred to in sub-paragraphs (i)(A) to (C)".
(2)In the Schedule to the Transport (Rail Safety) Regulations 1998, in item 3(c)(iii), for "those amounts" (where first occurring) substitute "the amounts referred to in sub-paragraph (i)".
