Residential Tenancies Act 1997

Residential Tenancies (Infringement Penalties) Regulations 2006

The Governor in Council makes the following Regulations:

1.Objective

The objective of these Regulations is to amend the Residential Tenancies Regulations 1998 to prescribe infringement penalties.

2.Authorising provision

These Regulations are made under section 511 of the Residential Tenancies Act 1997.

3.Commencement

These Regulations come into operation on 1 February 2006.

4.Principal Regulations

In these Regulations the Residential Tenancies Regulations 1998[1] are called the Principal Regulations.

5.Objectives

In regulation 1 of the Principal Regulations—

(a)in paragraph (d), for "rent." substitute
"rent; and";

(b)after paragraph (d) insert—

"(e)to specify infringement penalties for the purposes of the Act.".

6.Amendment to references to the Schedule

In regulations 6, 7, 8, 8A, 9, 9A, 10, 11, 12, 13, 14, 15, 17, 18, 19, 19A, 19B and 19C of the Principal Regulations, for "the Schedule" substitute "Schedule 1".

7.New regulation 24 inserted

After regulation 23 of the Principal Regulations insert—

"24.Infringement Penalties

For the purposes of section 510D(e) of the Act, the infringement penalty for an alleged offence specified in Schedule 2 to the Act is the amount expressed in penalty units in column 2 of Schedule 2 to these Regulations opposite the relevant offence in column 1 of that Schedule.".

8.Schedule 2 inserted

(1)In the Schedule to the Principal Regulations, for "SCHEDULE" (where first occurring) substitute—

"SCHEDULES

(2)At the end of Form 17 insert—
