Road Safety (Road Rules) (Commonwealth Games) Regulations 2006
The Governor in Council makes the following Regulations:

1.Objective
The objective of these Regulations is to amend the Road Safety (Road Rules) Regulations 1999—
(a)to authorise VicRoads to erect traffic control items for Commonwealth Games purposes; and
(b)to enable the establishment of special Commonwealth Games lanes for the use of authorised Commonwealth Games vehicles for certain periods.
2.Authorising provision
These Regulations are made under section 95 of the Road Safety Act 1986.
3.Commencement
(1)These Regulations (other than regulation 6) come into operation on the day after the day on which they are made.
(2)Regulation 6 comes into operation on 1 April 2006.
4.New regulation 303B inserted
After regulation 303A of the Road Safety (Road Rules) Regulations 1999[1] insert—
'303B.Corporation may erect traffic control items for Commonwealth Games related purposes
(1)The Corporation may erect, establish, display, maintain or remove a traffic control item on any road for the purposes of facilitating preparation for, the conduct of, or the management of traffic in connection with the Commonwealth Games, a Commonwealth Games Event, a Commonwealth Games Project or a Games Village Project.
(2)In this regulation, "Commonwealth Games", "Commonwealth Games Event", "Commonwealth Games Project" and "Games Village Project" have the same meaning as in the Commonwealth Games Arrangements Act 2001.'.
5.Commonwealth Games lanes
At the end of Schedule 4 to the Road Safety (Road Rules) Regulations 1999 insert—
'31.The Road Rules are to be read as if, after rule 157, the following rule were inserted—
"157A.Commonwealth Games lanes
(1)A driver (except the driver of a Games authorised vehicle) must not drive in a Commonwealth Games lane, unless the driver is permitted to drive in the Commonwealth Games lane under this rule or rule 158.
Penalty:2 penalty units.
NoteRule 158 provides additional exceptions applying to this rule, and also provides a defence to the prosecution of a driver for an offence against this rule.
(2)If stopping or parking is not prohibited at a place in a Commonwealth Games lane, a driver may drive for up to 50 metres in the Commonwealth Games lane to stop or park at that place.
NotePart 12 deals with parking and restricted stopping areas.
(3)A driver may drive for up to 50 metres in a Commonwealth Games lane if the driver is driving a public bus, public minibus, or taxi, and is dropping off or picking up, passengers.
NotePublic bus, public minibus and taxi are defined in the dictionary.
(4)The Commonwealth Games Corporation may issue a permit in respect of a vehicle for the purposes of this rule.
(5)In this rule—
Commonwealth Games Corporation means the Melbourne 2006 Commonwealth Games Corporation established under the Commonwealth Games Arrangements Act 2001.
Commonwealth Games lane means a marked lane, or the part of a marked lane—
(a)beginning at a Games lane sign; and
(b)ending at an end Games lane sign.
NoteMarked lane is defined in the dictionary.

Games authorised vehicle means a vehicle which displays a permit issued under subrule (4) by the Commonwealth Games Corporation.".
32.Road Rule 158 is to be read as if—
(a)in subrules (1), (2) and (3), for "transit lane or truck lane" there were substituted "transit lane, truck lane or Commonwealth Games lane"; and
(b)for note 2 at the foot of subrule (1) there were substituted—
"Note 2 Bicycle lane is defined in rule 153, bus lane is defined in rule 154, Commonwealth Games lane is defined in rule 157A, emergency stopping lane is defined in rule 95, centre of the road, marked lane, overtake, right change of direction signal, service road and U‑turn are defined in the dictionary, tram lane is defined in rule 155, transit lane is defined in rule 156, and truck lane is defined in rule 157."; and
(c)in subrule (4), in paragraph (a) of the definition of "permitted distance", for "a bicycle lane" there were substituted "a bicycle lane or a Commonwealth Games lane".
33.The Dictionary at the end of the Road Rules is to be read as if—
(a)the following definition of "Commonwealth Games lane" were inserted in alphabetical order—
"Commonwealth Games lane see rule 157A."; and
(b)for the definition of "special purpose lane" and the note at the foot of that definition there were substituted—
"special purpose lane means a marked lane, or the part of a marked lane, that is a bicycle lane, bus lane, Commonwealth Games lane, emergency stopping lane, tram lane, transit lane or truck lane.
NoteBicycle lane is defined in rule 153, bus lane is defined in rule 154, Commonwealth Games lane is defined in rule 157A, emergency stopping lane is defined in rule 95, marked lane is defined in this dictionary, tram lane is defined in rule 155, transit lane is defined in rule 156, and truck lane is defined in rule 157.".'.
6.Revocation of rules relating to Commonwealth Games lanes
Regulation 303B of, and items 31 to 33 in Schedule 4 to, the Road Safety (Road Rules) Regulations 1999 are revoked.
