Magistrates' Court General (Further Waiver Amendment) Regulations 2006

The Lieutenant-Governor as the Governor's Deputy with the advice of the Executive Council makes the following Regulations:

1.Objective

The objective of these Regulations is to amend the Magistrates' Court General Regulations 2000 to further provide for the waiver of certain fees and costs payable in respect of infringement penalties registered under Schedule 7 to the Magistrates' Court Act 1989 for which an infringement notice was issued or served by a non-Government agency.

2.Authorising provision

These Regulations are made under section 140 of the Magistrates' Court Act 1989.

3.Commencement

These Regulations come into operation on 15 March 2006.

4.Principal Regulations

In these Regulations, the Magistrates' Court General Regulations 2000[1] are called the Principal Regulations.

5.Definitions

In regulation 1211 of the Principal Regulations—

(a)insert the following definition—

' "third waiver period" means the period commencing on 15 March 2006 and ending on 31 May 2006;';

(b)for paragraph (b) of the definition of "relevant waiver period" substitute

"(b)in respect of a registered infringement penalty for which an infringement notice was issued or served by a non-Government enforcement agency listed in Part 1 of Schedule 11, the second waiver period;

(c)in respect of a registered infringement penalty for which an infringement notice was issued or served by a non-Government enforcement agency listed in Part 2 of Schedule 11, the third waiver period;".

6.Insertion of Part headings and further agencies in Schedule 11

(1)After the heading to Schedule 11 to the Principal Regulations insert

"PART 1—SECOND WAIVER PERIOD".

(2)After item 9 in Schedule 11 to the Principal Regulations insert

"PART 2—THIRD WAIVER PERIOD

1.      Brimbank City Council

2.     Central Goldfields Shire

3.     East Gippsland Shire Council

4.     Frankston City Council

5.     Glen Eira City Council

6.     Greater Geelong City Council

7.     Maroondah City Council

8.     Melbourne City Council

9.     Queenscliff Borough Council

10.     Shire of Yarra Ranges

11.     South Gippsland Shire Council

12.     West Wimmera Shire Council".
