Electricity Safety Act 1998

Electricity Safety (Equipment Efficiency) (Amendment) Regulations 2006

The Governor in Council makes the following Regulations:

1.Objective

The objective of these Regulations is to amend the Electricity Safety (Equipment Efficiency) Regulations 1999—

(a)to prescribe further minimum standards of energy efficiency and performance for single-phase household airconditioners and heat pumps; and

(b)to prescribe further minimum efficiency requirements for three-phase cage induction motors, including minimum high efficiency requirements for motors marked or labelled as high efficiency.

2.Authorising provisions

These Regulations are made under sections 154 and 157 of the Electricity Safety Act 1998.

3.Commencement

These Regulations come into operation on 1 April 2006.

4.Principal Regulations

In these Regulations the Electricity Safety (Equipment Efficiency) Regulations 1999[1] are called the Principal Regulations.

5.Definitions

(1)In regulation 5(1) of the Principal Regulations, for the definition of "AS/NZS 1359.5:2000" substitute

' "AS/NZS 1359.5:2004" means AS/NZS 1359.5:2004 as referred to in Schedule 4 and amended from time to time;'.

(2)In regulation 5(1) of the Principal Regulations, the definitions of "AS 1359.102.1—1997" and "AS/NZS 1359.102.3:2000" are revoked.

(3)In regulation 5(1) of the Principal Regulations, for the definition of "AS/NZS 3823.2:2003" substitute

' "AS/NZS 3823.2:2005" means AS/NZS 3823.2:2005 as referred to in Schedules 3 and 4 and amended from time to time;'.

(4)In regulation 5(1) of the Principal Regulations, in the definitions of "single-phase commercial airconditioner or heat pump" and "single-phase household airconditioner or heat pump", for "AS/NZS 3823.2:2003" (wherever occurring) substitute "AS/NZS 3823.2:2005".

6.Minimum standards for energy efficiency and performance

(1)For regulation 6(2A) of the Principal Regulations substitute

"(2A)Single-phase household airconditioners and heat pumps must, in addition to the requirements under sub-regulation (1), comply with—

(a)the minimum energy performance standard set out in clause 3.2 of AS/NZS 3823.2:2005 when tested in accordance with clauses 3.4, 3.5, 3.6 and 3.7 of AS/NZS 3823.2:2005 by an accredited or approved laboratory; or

(b)in the case of a single-phase airconditioner or heat pump labelled or marked as having Class A efficiency, the minimum energy performance standard set out in clause 3.3 of AS/NZS 3823.2:2005 when tested in accordance with clauses 3.4, 3.5, 3.6 and 3.7 of AS/NZS 3823.2:2005 by an accredited or approved laboratory.".

(2)For regulation 6(4) of the Principal Regulations substitute

"(4)Three-phase cage induction motors must comply with—

(a)the minimum efficiency requirements set out in clause 2.2 of AS/NZS 1359.5:2004 when tested in accordance with clause 2.2 of AS/NZS 1359.5:2004 by an accredited or approved laboratory; or

(b)the minimum efficiency requirements set out in clause 2.3 of AS/NZS 1359.5:2004 when tested in accordance with clause 2.3 of AS/NZS 1359.5:2004 by an accredited or approved laboratory; or

(c)in the case of a three-phase cage induction motor labelled or marked as a high efficiency motor, the minimum high efficiency requirements set out in clause 3.2 or 3.3 of AS/NZS 1359.5:2004 when tested in accordance with clause 3.2 or 3.3 of AS/NZS 1359.5:2004 (as the case requires) by an accredited or approved laboratory.".

(3)In regulation 6(5) of the Principal Regulations—

(a)for "AS/NZS 3823.2:2003" (wherever occurring) substitute "AS/NZS 3823.2:2005";

(b)in paragraph (b), for "clauses 3.4, 3.5 and 3.6" substitute "clauses 3.4, 3.5, 3.6 and 3.7".

7.Applications for registration

(1)In regulation 8(3A) of the Principal Regulations—

(a)for "AS/NZS 1359.5:2000" (wherever occurring) substitute "AS/NZS 1359.5:2004";

(b)for "Appendix A" substitute "Appendix C".

(2)In regulations 8(3B) and 8(3C) of the Principal Regulations, for "AS/NZS 3823.2:2003" (wherever occurring) substitute


"AS/NZS 3823.2:2005".

8.Revocation of certain provisions

Regulations 16(2), 16(3) and 16(4) of the Principal Regulations are revoked.

9.Labelling of single-phase commercial and three-phase household airconditioners and heat pumps

In regulation 16C of the Principal Regulations, for "AS/NZS 3823.2:2003" (wherever occurring), substitute "AS/NZS 3823.2:2005".

10.Labelling or marking of three-phase cage induction motors

In regulation 16D of the Principal Regulations, for "clause 3.1 or clause 3.2 of AS/NZS 1359.5:2000" substitute "clause 3.2 or clause 3.3 of AS/NZS 1359.5:2004".

11.Substitution of regulation 25

For regulation 25 of the Principal Regulations substitute

"25.Transitional—single-phase household airconditioners and heat pumps

(1)Despite regulations 6(1) and 6(2A), a single-phase household airconditioner or heat pump that before 21 December 2004—

(a)was registered and labelled in accordance with these Regulations as in force immediately before that date; and

(b)complied with the performance criteria set out in regulation 6(1) as in force immediately before that date—

is deemed to be registered and labelled in accordance with these Regulations and to comply with these Regulations if it continues to be so labelled and so compliant.

Note:This provision is a re-enactment, with minor changes, to regulation 25 as in force immediately before 1 April 2006.

(2)Despite regulations 6(1) and 6(2A), a single-phase household airconditioner or heat pump that—

(a)was manufactured in or imported into Australia during the period beginning on 21 December 2004 (including that day) and ending on 31 March 2006; and

(b)was registered and labelled during that period in accordance with these Regulations as in force during that period; and

(c)complied with the performance criteria set out in regulations 6(1) and 6(2A) as in force during that period—

is deemed to be registered and labelled in accordance with, and to comply with, these Regulations if it continues to be so labelled and so compliant.".

12.Insertion of new regulation 29

After regulation 28 of the Principal Regulations insert

"29.Transitional—three-phase cage induction motors registered before 1 April 2006

(1)Despite regulation 6(4), a three-phase cage induction motor that before 1 April 2006—

(a)was registered in accordance with these Regulations as in force immediately before that date; and

(b)complied with the requirements of regulation 6(4) as in force immediately before that date—

is deemed to be registered in accordance with, and to comply with, these Regulations if it continues to be so compliant.

(2)Despite regulation 6(4), a three-phase cage induction motor labelled or marked as a high efficiency motor that before 1 April 2006—

(a)was registered and labelled or marked in accordance with these Regulations as in force immediately before that date; and

(b)complied with the requirements of regulation 6(4) as in force immediately before that date—

is deemed to be registered and labelled or marked in accordance with, and to comply with, these Regulations if it continues to be so labelled or marked and so compliant.".

13.Amendment of Schedule 3 to update references

In item 4 of Schedule 3 to the Principal Regulations, for "AS/NZS 3823.2:2003" substitute "AS/NZS 3823.2:2005".

14.Amendment of Schedule 4 to update references

(1)In item 2 of Schedule 4 to the Principal Regulations—

(a)for "AS/NZS 1359.5:2000; and" substitute "AS/NZS 1359.5:2004.";

(b)Omit

"Australian/New Zealand Standard, 'Rotating electrical machines—General requirements Part 102.3: Methods for determining losses and efficiency—Three-phase cage induction motors', AS/NZS 1359.102.3:2000; and

Australian Standard, 'Rotating electrical machines—General requirements Part 102.1: Methods for determining losses and efficiency—General', AS 1359.102.1—1997.".

(2)In items 3 and 4 of Schedule 4 to the Principal Regulations, for "AS/NZS 3823.2:2003" substitute "AS/NZS 3823.2:2005".

"AS/NZS 1359.5:2004" means "Australian/New Zealand Standard, Rotating electrical machines—General requirements Part 5: Three-phase cage induction motors—High efficiency and minimum energy performance standards requirements", AS/NZS 1359.5:2004;

"The Principal Regulations" means the Electricity Safety (Equipment Efficiency) Regulations 1999.
