Victorian Civil and Administrative Tribunal Act 1998

Victorian Civil and Administrative Tribunal (Amendment No. 16) Rules 2006

The Rules Committee established by section 150 of the Victorian Civil and Administrative Tribunal Act 1998 makes the following Rules:

1.Object

The object of these Rules is to make miscellaneous amendments to the Victorian Civil and Administrative Tribunal Rules 1998.

2.Authorising provisions

These Rules are made under section 157 of the Victorian Civil and Administrative Tribunal Act 1998 and all other enabling powers.

3.Commencement

These Rules come into operation on 1 June 2006.

4.Substitution of Rule 4.09

For Rule 4.09 of the Victorian Civil and Administrative Tribunal Rules 1998[1], substitute—

"4.09Direction to submit to medical or other examination

The Tribunal may, if the physical or mental condition of a party is relevant to a proceeding, require the party to submit to a medical, psychological or other examination by an expert whom another party proposes to call as a witness or otherwise as the Tribunal directs.".

5.Revocation of certain Rules regarding the inspection of files

Rule 5.04, Part 5 of Order 5, Rules 6.08, 6.17(2) and 6.24 of the Victorian Civil and Administrative Tribunal Rules 1998 are revoked.

6.Amendments to Schedules 1 and 2—Allocation of functions

(1)In Schedule 1 to the Victorian Civil and Administrative Tribunal Rules 1998, in Part 1—

(a)after paragraph 1(b) insert—

"(ba)Associations Incorporation Act 1981;";

(b)after paragraph 1(c) insert—

"(ca)Cemeteries and Crematoria Act 2003;";

(c)after paragraph 1(e) insert—

"(ea)Co-operatives Act 1996;";

(d)for paragraph 1(i) substitute—

"(i)Drugs, Poisons and Controlled Substances Act 1981;";

(e)after paragraph 1(i) insert—

"(iaa)Electoral Act 2002;";

(f)after paragraph 1(m) insert—

"(ma)Fisheries Act 1995;";

(g)for paragraph 1(o) substitute—

"(o)Fundraising Appeals Act 1998;";

(h)paragraphs 1(q), 1(r) and 1(u) are revoked;

(i)in paragraph 1(v) for "clause 7 of Schedule 5" substitute "clause 8 of Schedule 12";

(j)for paragraph 1(w) substitute—

"(w)Melbourne and Metropolitan Board of Works Act 1958;";

(k)paragraph 1(za) is revoked;

(l)after paragraph 1(zb) insert—

"(zba)Road Management Act 2004;";

(m)paragraph 1(zh) is revoked;

(n)for paragraph 1(zm) substitute—

"(zm)Victoria State Emergency Service Act 2005;";

(o)for paragraph 1(zo) substitute—

"(zo)Victorian Qualifications Authority Act 2000.".

(p)paragraphs 2(b), 2(j) and 2(k) are revoked;

(q)paragraphs 3(d), 3(g), 3(m) and 3(n) are revoked;

(r)after paragraph 3(o) insert—

"(oa)Gambling Regulation Act 2003;

(ob)Health Professions Registration Act 2005;";

(s)paragraph 3(q) is revoked;

(t)in paragraph 3(u) omit "sections 94 (mine manager's certificates) and 95 (panel inquiries into fitness of mine managers)";

(u)in paragraph (x), omit "Occupational Health and Safety Act 1985
section 59(6)—";

(v)paragraph 3(zba) is revoked;

(w)for paragraph 3(zc) substitute—

"(zc)Professional Boxing and Combat Sports Act 1985 (licences, permits and registration);";

(x)after paragraph 3(zd) insert—

"(zda)Psychologists Registration Act 2000;";

(y)for paragraph 3(zl) substitute—

"(zl)Victoria State Emergency Service Act 2005;";

(z)for paragraphs 3(zm) and 3(zn) substitute—

"(zm)Wildlife Act 1975;

(zn)Working with Children Act 2005.";

(za)paragraph 4(g) is revoked;

(zb)paragraphs 5(b), 5(c), 5(d), 5(f), 5(g) and 5(h) are revoked.

(2)In Schedule 1 to the Victorian Civil and Administrative Tribunal Rules 1998, in Part 2—

(a)for paragraph 2(b) substitute—

"(b)Owner Drivers and Forestry Contractors Act 2005.";

(b)after paragraph 6(ab) insert—

"(aba) Property Law Act 1958 Part IV;";

(c)for paragraph 7(d) substitute—

"(d)Retirement Villages Act 1986;

(e)Housing (Housing Agencies) Act 2004.";

(d)for paragraphs 8(ab) and (b) substitute—

"(b)Retail Leases Act 2003.".

(3)In Schedule 1 to the Victorian Civil and Administrative Tribunal Rules 1998, in Part 3, for—

"Equal Opportunity Act 1995."

substitute—

"(a)Equal Opportunity Act 1995;

(b)Racial and Religious Tolerance Act 2001.".
