Bail (Amendment) Regulations 2006

The Governor in Council makes the following Regulations:

1.Objective

The objective of these Regulations is to amend the form of an undertaking of bail consequent to the enactment of the Infringements Act 2006.

2.Authorising provision

These Regulations are made under section 33 of the Bail Act 1977.

3.Commencement

These Regulations come into operation on 15 August 2006.

4.Amendment to form of undertaking of bail

In Form 1 of the Bail Regulations 2003[1]—

(a)for "Nature of Charge" substitute "*Nature of charge/You have been arrested under an infringement warrant issued under section 80 of the Infringements Act 2006.";

(b)for "the defendant" (wherever occurring) substitute "*the defendant/infringement offender";

(c)for "Signature of Defendant" substitute "Signature of *Defendant/Infringement Offender";

(d)for "accused person" (where twice occurring) substitute "*accused person/infringement offender";

(e)for—

"Defendant

Defendant's Address
Defendant's Occupation
Nature of Charge (State Briefly)"

substitute—

"*Defendant/Infringement Offender

*Defendant's/Infringement Offender's Address
*Defendant's/Infringement Offender's Occupation
*Nature of Charge (State Briefly)/Infringements Court Case Number that appears on the Infringement warrant";

(f)for "The defendant" substitute "The *defendant/infringement offender";

(g)after—

"*An officer in charge of the prison at               of or above the rank of Senior Prison Officer."

insert—

"*The sheriff or another person authorised by the Infringements Act 2006 to discharge the infringement offender from custody on bail.".
