Corrections (Victims Register) (Amendment) Regulations 2006

The Governor in Council makes the following Regulations:

1.Objective

The objective of these Regulations is to amend the Corrections (Victims Register) Regulations 2004 consequential on the Corrections and Other Justice Legislation (Amendment) Act 2006 and to make an amendment of a statute law revision nature.

2.Authorising provision

These Regulations are made under section 112 of the Corrections Act 1986.

3.Principal Regulations

In these Regulations, the Corrections (Victims Register) Regulations 2004[1] are called the Principal Regulations.

4.The registrar

In regulation 6 of the Principal Regulations, for "Public Sector Management and Employment Act 1998" substitute "Public Administration Act 2004".

5.Manner of application

In regulation 8(2)(b) of the Principal Regulations, after "prisoner" insert "or the offender who is or was subject to an extended supervision order, or an application for an extended supervision order,".

6.Content of application

In regulation 9(c) of the Principal Regulations, after "prisoner" insert "or the offender who is or was subject to an extended supervision order, or an application for an extended supervision order,".

7.Removal from register

(1)In regulation 12(1) of the Principal Regulations insert the following definition—

' "relevant offender" means the offender who is or was subject to an extended supervision order, or application for an extended supervision order, in relation to whom a registered person is included on the victims register;'.

(2)In regulation 12(2)(e) of the Principal Regulations—

(a)after "section 30A(2)" insert "or 30A(2AA)";

(b)for "the safety and welfare of any other person;" substitute "the safety or welfare of the relevant offender or the safety or welfare of any other person;".

(3)After regulation 12(2)(g) of the Principal Regulations insert

"(ga)if the extended supervision order of the relevant offender has expired and has not been replaced by another extended supervision order;".

(4)In regulation 12(2)(k) of the Principal Regulations, after "relevant prisoner" insert


"or the relevant offender".

8.Amendment of Schedule

In the Schedule to the Principal Regulations, after "prisoner" insert "or name of offender who is or was subject to an extended supervision order or an application for an extended supervision order".
