Conservation, Forests and Lands (Catchment and Land Protection Infringement Notice) (Amendment) Regulations 2006

The Lieutenant-Governor as the Governor's Deputy with the advice of the Executive Council makes the following Regulations:

1.Objective

The objective of these Regulations is to amend Schedule 2 to the Conservation, Forests and Lands (Infringement Notice) Regulations 2002—

(a)to prescribe further offences against a relevant law for which an infringement notice may be served; and

(b)to prescribe penalties for those prescribed offences.

2.Authorising provision

These Regulations are made under section 99 of the Conservation, Forests and Lands Act 1987.

3.Amendments to Schedule 2

In Schedule 2 to the Conservation, Forests and Lands (Infringement Notice) Regulations 2002[1] after item 325 insert

"CATCHMENT AND LAND PROTECTION

326 6950 An offence under section 47D(1)
of the Catchment and Land Protection Act 1994
4 penalty units as a land owner, fail to take one or more of the measures specified in a priority area  notice, in accordance with the notice, within the time specified in the notice for taking measures
327 6951 An offence under section 70C of the Catchment and Land Protection Act 1994 4 penalty units as a land owner, fail to take one or more of the measures specified in a directions  notice, in accordance with the notice, within the time specified in the notice for taking measures
328 6952 An offence under section 46(1) of the Catchment and Land Protection Act 1994 2 penalty units as a land owner, fail to give notice in writing to the Secretary, within 7 days of the time for compliance
with a land management notice, that gives the prescribed  particulars as to any measures that the land owner has
taken to comply with a land management notice or the reason why the land owner has not taken any such measures
329 6953 An offence under section 47E(1) of the Catchment and Land Protection Act 1994 2 penalty units as a land owner, fail to give notice in writing to the Secretary, within 7 days of the time for compliance with a priority area notice, that gives the prescribed  particulars as to any measures that the land owner has taken to comply with a priority area notice or the reason why the land owner has not taken any such measures
330 6954 An offence under section 70D(1)
of the Catchment and Land Protection Act 1994
2 penalty units as a land owner, fail to give notice in writing to the Secretary, within 7 days of the time for compliance with a directions notice, that gives the prescribed  particulars as to any measures that the land owner has taken to comply with a directions notice or the reason why the land owner has not taken any such measures".
