Road Safety Act 1986

Road Safety (General) (Infringements) Regulations 2006

The Lieutenant-Governor as the Governor's Deputy with the advice of the Executive Council makes the following Regulations:

1.Objective

The objective of these Regulations is to amend the Road Safety (General) Regulations 1999 to update provisions relating to infringements.

2.Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3.Service of parking infringement notices

For regulation 501(1)(c) of the Road Safety (General) Regulations 1999[1] substitute—

"(c)by serving the notice in accordance with section 93 of the Act on the registered operator of the vehicle or, if the name and address of a person has been supplied under section 86(3) of the Act, on that person.".

4.Infringement notices and penalties

Regulations 502 and 602 of the Road Safety (General) Regulations 1999 are revoked.

5.Particulars of traffic infringement notice

In regulation 603(1) of the Road Safety (General) Regulations 1999—

(a)for "88(2) of the Act, the prescribed particulars" substitute "88(2)(c) of the Act, the additional prescribed details";

(b)paragraphs (a), (b), (d), (h), (i), (j), (k) and (l) are revoked;

(c)in paragraph (g)(ii), for "service of" substitute "the date of";

(d)paragraphs (g)(iii) and (g)(iv) are revoked;

(e)in paragraph (ga)(ii), for "service of" substitute "the date of".

6.Payment of penalty

In regulation 604 of the Road Safety (General) Regulations 1999 omit "89(3),".

7.Traffic infringements

In Schedule 4 to the Road Safety (General) Regulations 1999 item 2166 is revoked.
