Magistrates' Court Act 1989

Magistrates' Court Civil Procedure (Amendment No. 16) Rules 2006

The Chief Magistrate together with 2 Deputy Chief Magistrates jointly make the following Rules:

1.Object

The object of these Rules is to amend the Magistrates' Court Civil Procedure Rules 1999—

(a)to make further provision with respect to the address for service of a defendant who has been served with a complaint under the Service and Execution of Process Act 1992 of the Commonwealth; and

(b)to amend item 57, insert a new item 57A and to increase the Scale of Costs in Appendix A.

2.Authorising provisions

These Rules are made under section 16 of the Magistrates' Court Act 1989 and all other enabling powers.

3.Commencement

These Rules come into operation on 1 January 2007.

4.Notice of defence after service

After Rule 9.01(4) of the Magistrates' Court Civil Procedure Rules 1999[1] insert—

"(4.1)Despite sub-rule (4), if the complaint was served on the defendant under the Service and Execution of Process Act 1992 of the Commonwealth, the address for service of the defendant duly stated in a notice of defence in accordance with that Act is the address for service of the defendant.".

5.Amendments to Appendix A

In Appendix A to the Magistrates' Court Civil Procedure Rules 1999, in the Scale of Costs—

(a)in item 1—

(i)in paragraph (a), for "147" substitute "153";

(ii)in paragraph (b), for "307" substitute "320";

(iii)in paragraph (c), for "377" substitute "393";

(iv)in paragraph (d), for "451" substitute "470";

(v)in paragraph (e), for "562" substitute "585";

(vi)in paragraph (f) , for "676" substitute "704";

(vii)in paragraph (g), for "809" substitute "842";

(b)in item 57, omit "or at the hearing of an application for revocation of a direction of a conciliation officer";

(c)after item 57 insert—

(d)in item 82—
