Water Industry Act 1994
Water Industry (Prescribed Persons) (Amendment) Regulations 2006
The Governor in Council makes the following Regulations:

1.Objective
The objective of these Regulations is to amend the Water Industry (Prescribed Persons) Regulations 2003 to prescribe persons who may bring proceedings for certain offences against Part 3 of the Water Industry Act 1994.
2.Authorising provision
These Regulations are made under section 184 of the Water Industry Act 1994.
3.Commencement
These Regulations come into operation on 21 December 2006.
4.Prescribed persons
At the end of regulation 4 of the Water Industry (Prescribed Persons) Regulations 2003[1] insert—
"(2)For the purposes of section 179(1) of the Water Industry Act 1994 a person who is an authorised officer appointed under section 83 of the Conservation, Forests and Lands Act 1987 for the purposes of Part 4 and section 184(2) and (3) of the Water Industry Act 1994 is a prescribed person for the purposes of bringing proceedings for an offence against section 78H(1), 78H(2), 78H(3), 78H(4) or 78O of the Water Industry Act 1994.
Note:Sections 78H and 78O are in Part 3 of the Water Industry Act 1994. Part 3 of the Water Industry Act 1994 is not a relevant law under the Conservation, Forests and Lands Act 1987.".
