Dangerous Goods (Explosives) Amendment Regulations 2008

The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Dangerous Goods (Explosives) Regulations 2000 to prohibit the transport of certain explosives in or through EastLink tunnels and on certain roads approaching those tunnels.

2Authorising provision

These Regulations are made under section 52 of the Dangerous Goods Act 1985.

3Note inserted in regulation 614

At the foot of regulation 614(1) of the Dangerous Goods (Explosives) Regulations 2000[1] insert¾

"Note

The requirement to display a Class Label is imposed under this Part by regulation 610 and clause 3.4 and paragraph 8.3.6 of the Australian Explosives Code.".

4New regulation 614A inserted

After regulation 614 of the Dangerous Goods (Explosives) Regulations 2000 insert¾

"614A   Restrictions on the transport of certain explosives through EastLink tunnels and approach roads

(1)The owner, driver and person in charge of a road vehicle must ensure that the road vehicle is not used to transport or carry explosives of a type or in a quantity which, under this Part, requires the display of a Class Label on that vehicle—

(a)in or through any tunnel that forms a part of EastLink; or

(b)on any carriageway that forms an entrance ramp to any tunnel that forms a part of EastLink; or

(c)on that part of the eastbound carriageway of EastLink between the Springvale Road exit, Nunawading, and the tunnel entrance; or

(d)on that part of the northbound carriageway of EastLink between the Maroondah Highway (Whitehorse Road) exit, Ringwood, and the tunnel entrance; or

(e)on that part of the westbound carriageway of the Ringwood Bypass Road leading to the EastLink tunnel west of the ramp onto the southbound carriageway of EastLink, Ringwood.

Note

The requirement to display a Class Label is imposed under this Part by regulation 610 and clause 3.4 and paragraph 8.3.6 of the Australian Explosives Code.

(2)In this regulation, EastLink means any land declared from time to time under section 143 of the EastLink Project Act 2004 to be a road and includes any part of that land.".
