Road Safety (Drivers) (Miscellaneous Amendments) Regulations 2008

The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Road Safety (Drivers) Regulations 1999—

(a)to amend the definition of experienced driver; and

(b)to increase the demerit points for level crossing offences.

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Commencement

These Regulations come into operation on 16 April 2008.

4Principal Regulations

In these Regulations the Road Safety (Drivers) Regulations 1999[1] are called the Principal Regulations.

5Definition of experienced driver substituted

In regulation 104 of the Principal Regulations for the definition of experienced driver substitute

"experienced driver, in relation to a motor vehicle, means a person who at the relevant time holds—

(a)a full driver licence which authorises the person to drive that motor vehicle; or

(b)an appropriate licence or permit which would exempt the person from the requirements of section 18(1)(a) of the Act in respect of the driving of that motor vehicle and which is not expressed to be learner, provisional or probationary;".

6Demerit points for level crossing offences

(1)In regulation 301 of the Principal Regulations in column 2 of Table 301 in the item relating to "Failing to give way, or stop or remain stopped" omit ", 121, 123".

(2)After the final item in Table 301 in regulation 301 of the Principal Regulations insert the following item—

"

Failing to stop or give way, or remain stopped at a level crossing or unlawfully enter a level crossing RSA 68B, RR 121, 122, 123, 124 4

".
