Water (Lake Eildon Recreational Area) (Houseboats) Amendment Regulations 2008

The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Water (Lake Eildon Recreational Area) (Houseboats) Regulations 2003—

(a)to increase the maximum fees payable for houseboat licences; and

(b)to convert the maximum fees specified in monetary amounts to fee units; and

(c)to make other minor amendments.

2Authorising provision

These Regulations are made under section 324 of the Water Act 1989.

3Commencement

These Regulations come into operation on 20 April 2008.

4Principal Regulations

In these Regulations the Water (Lake Eildon Recreational Area) (Houseboats) Regulations 2003[1] are called the Principal Regulations.

5Amendment of authorising provisions

In regulation 2 of the Principal Regulations, for "107" substitute "122ZF".

6Definitions

In regulation 4 of the Principal Regulations—

(a)insert the following definition—

"Water Corporation means the Goulburn-Murray Rural Water Corporation;";

(b)the definition of Water Authority is revoked.

7Water Corporation substituted for Water Authority

(1)In regulations 6, 7, 9, 10 and 11 of the Principal Regulations, for "Authority" (wherever occurring) substitute "Corporation".

(2)In the heading to Schedule 1 to the Principal Regulations, for "Authority" substitute "Corporation".

(3)In clause 6.3 of Schedule 2 to the Principal Regulations, for "Authority" substitute "Corporation".

8Amendment of Schedule 3

(1)In Part 1 of Schedule 3 to the Principal Regulations—

(a)in item 1 for "$250.00" substitute "23·25 fee units";

(b)in item 2 for "$545.00" substitute "50·69 fee units";

(c)in item 3a for "$814.00" substitute "75·71 fee units";

Fee Units

These Regulations amend the Water (Lake Eildon Recreational Area) (Houseboats) Regulations 2003 to provide for fees by reference to fee units within the meaning of the Monetary Units Act 2004.

The amount of the fee is to be calculated, in accordance with section 7 of that Act, by multiplying the number of fee units applicable by the value of a fee unit.

The value of a fee unit for the financial year commencing 1 July 2007 is $11.02.  The amount of the calculated fee may be rounded to the nearest 10 cents.

The value of a fee unit for future financial years is to be fixed by the Treasurer under section 5 of the Monetary Units Act 2004.  The value of a fee unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year.
