Public Transport Competition (Amendment) Regulations 2008
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Public Transport Competition Regulations 1999—
(a)to provide for the Director of Public Transport and the Safety Director to exercise certain powers under those regulations; and
(b)to exclude certain classes of road transport passenger service from the ambit of the definition of road transport passenger service under the Public Transport Competition Act 1995.
2Authorising provision
These Regulations are made under section 38 of the Public Transport Competition Act 1995.
3Commencement
These Regulations come into operation on 21 May 2008.
4Principal Regulations
In these Regulations, the Public Transport Competition Regulations 1999[1] are called the Principal Regulations.
5Director of Public Transport to exercise certain powers
In regulations 6, 9(k) and 17 of the Principal Regulations, for "Secretary" (wherever occurring) substitute "Director".
6Safety Director to exercise certain powers
In regulations 8(1)(b), 9 (except paragraph (k)), 10, 12(b), 15, 16 and 18 of the Principal Regulations, for "Secretary" (wherever occurring) substitute "Safety Director".
7New regulation 6A inserted
After regulation 6 of the Principal Regulations insert—
"6A Road transport passenger service—Prescribed classes of road transport passenger service
For the purposes of the definition of road transport passenger service in section 3(1) of the Act, the following classes of road transport passenger service are excluded from the ambit of the definition—
(a)a service or class of service operated by way of hire car within the meaning of the Transport Act 1983; and
(b)a service or class of service operated by way of special purpose vehicle within the meaning of the Transport Act 1983.".
