Travel Agents (Infringement Penalties) Regulations 2008

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Travel Agents Regulations 2007 to prescribe infringement penalties.

2Authorising provision

These Regulations are made under section 48 of the Travel Agents Act 1986.

3Principal Regulations

In these regulations the Travel Agents Regulations 2007[1] are called the Principal Regulations.

4Amendment of objectives

In regulation 1 of the Principal Regulations for "fees and forms," substitute "fees, forms and infringement penalties,".

5New regulation 16 inserted

After regulation 15 of the Principal Regulations insert

"16   Infringement penalties

For the purposes of section 39ZC(2) of the Act, the infringement penalty for an offence—

(a)against section 8(5), 11A(2), 18A(3), 24, 30, 31 or 32(1) of the Act is 2×5 penalty units;

(b)against section 14(1), 17(11), 41(1) or 41(3) of the Act is 5 penalty units;

(c)against section 18 of the Act is 6×25 penalty units;

(d)against section 12(2) of the Act is 12 penalty units.".
