Working with Children Act 2005

Working with Children Amendment Regulations 2008

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Working with Children Regulations 2006—

(a)to prescribe application fees;

(b)to prescribe bodies for the purposes of sections 10(3)(b), 11(1)(b), 14(1)(a) and 21(1)(b) of the Working with Children Act 2005;

(c)to prescribe findings for the purposes of section 14(1)(a) of the Working with Children Act 2005;

(d)to make other minor miscellaneous amendments.

2Authorising provision

These Regulations are made under section 49 of the Working with Children Act 2005.

3Commencement

These Regulations come into operation on 1 July 2008.

4New regulation 3A inserted

After regulation 3 of the Working with Children Regulations 2006[1] insert

"3A   Definitions

In these Regulations—

Suitability Panel means the Suitability Panel established under Part 3.4 of the Children, Youth and Families Act 2005;

Victorian Institute of Teaching means the Victorian Institute of Teaching continued under Part 2.6 of the Education and Training Reform Act 2006.".

5Application fee

(1)In regulation 7 of the Working with Children Regulations 2006, for "the Act" substitute "the Working with Children Act 2005".

(2)In the Table in regulation 7 of the Working with Children Regulations 2006—

(a)for "the Act" substitute "that Act";

(b)for "$71.70" substitute "6·51 fee units";

(b)for "$16.40" substitute "1·49 fee units".

6Secretary may reduce, waive or refund payment of fees

In regulation 8 of the Working with Children Regulations 2006—

(a)after "before or after an application" insert "of a kind referred to in the Table in regulation 7";

(b)for "any application fee" substitute "the corresponding application fee";

(c)for "Table to regulation 7" substitute "Table in that regulation".

7Prescribed bodies

For regulation 9 of the Working with Children Regulations 2006 substitute

"9   Prescribed bodies

For the purposes of sections 10(3)(b), 11(1)(b), 14(1)(a) and 21(1)(b) of the Working with Children Act 2005, the following bodies are prescribed—

(a)the Victorian Institute of Teaching;

(b)the Suitability Panel.".

8Findings of a prescribed kind

For regulation 10 of the Working with Children Regulations 2006 substitute

"10   Findings of a prescribed kind

For the purposes of section 14(1)(a) of the Working with Children Act 2005, the following are findings of a prescribed kind—

(a)a determination by a panel appointed under section 2.6.42 of the Education and Training Reform Act 2006 to do one or more of the following—

(i)impose conditions, limitations or restrictions on the registration of the teacher; or

(ii)suspend the registration of the teacher for the period and subject to the conditions, limitations and restrictions, if any specified in the determination; or

(iii)cancel the registration of the teacher;

(b)a finding by the Suitability Panel under section 106 of the Children, Youth and Families Act 2005 that a person should be disqualified from registration under Part 3.4 of that Act.".
