Road Safety (General) (Learner Approved Motor Cycle Scheme Amendment) Regulations 2008

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Road Safety (General) Regulations 1999 to prescribe offences for which traffic infringement notices may be issued and the penalties for those infringements.

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Commencement

These Regulations come into operation on 1 July 2008.

4Amendment of Schedule 4

(1)In Schedule 4 to the Road Safety (General) Regulations 1999[1], for the item in respect of Code 2086 substitute—

"2573	Holder of motor cycle licence for less than 12 months carrying pillion passenger	RS (D) R 211B(1)(b)	1×05 penalty units
2574	Holder of motor cycle learner permit carrying pillion passenger	RS (D) R 211B(2)(b)	1×05 penalty units".

(2)In Schedule 4 to the Road Safety (General) Regulations 1999, for the item in respect of Code 2111 substitute—

"2111 Breach of a condition of driver licence or permit in Table 207 in regulation 207 of RS (D) R (other than E condition) RSA 18(1)(b) 1×05 penalty units".

(3)In Schedule 4 to the Road Safety (General) Regulations 1999, after the item in respect of Code 2129 insert—

"2571	Holder of motor cycle licence for less than 12 months driving motor cycle that is not a learner approved motor cycle	RS (D) R 211B(1)(a)	1×05 penalty units
2572	Holder of motor cycle learner permit driving motor cycle that is not a learner approved motor cycle	RS (D) R 211B(2)(a)	1×05 penalty units".
