Prevention of Cruelty to Animals Act 1986

Prevention of Cruelty to Animals (Amendment) Regulations 2008

The Administrator of the State of Victoria as the Governor's deputy with the advice of the Executive Council, makes the following Regulations:

1Objective

The objective of these regulations is—

(a)to amend the Prevention of Cruelty to Animals Regulations 1997 to make further provision for identification certificates for POCTA inspectors; and

(b)to make other related amendments to those Regulations.

2Authorising provision

These Regulations are made under section 42 of the Prevention of Cruelty to Animals Act 1986.

3Identification certificates

In regulation 28(1)(a) of the Prevention of Cruelty to Animals Regulations 1997[1], for "to an inspector" substitute "to a general inspector".

4Consequential amendment of Schedule 3—Permit to operate a rodeo

In Part A(1) of Schedule 3 to the Prevention of Cruelty to Animals Regulations 1997, for "an inspector within the meaning of section 18 of the Prevention of Cruelty to Animals Act 1986" substitute "a POCTA inspector".

5Consequential amendment of Schedule 5—Permit to operate a rodeo school

In Part A(1) of Schedule 5 to the Prevention of Cruelty to Animals Regulations 1997, for "an inspector within the meaning of section 18 of the Prevention of Cruelty to Animals Act 1986" substitute "a POCTA inspector".

6Substitution of Schedule 7

For Schedule 7 to the Prevention of Cruelty to Animals Regulations 1997 substitute

"SCHEDULE 7

Regulation 28(1)(a)

CERTIFICATE OF IDENTIFICATION AS A GENERAL INSPECTOR

The bearer         , who is an employee of the          ,

and whose photograph and signature appear on this card, is approved as a general inspector under section 18 of the Prevention of Cruelty to Animals Act 1986 and is authorised to exercise the powers of a general inspector under Part 2A and Part 3A of that Act.

7Substitution of Schedule 8

For Schedule 8 to the Prevention of Cruelty to Animals Regulations 1997 substitute

"SCHEDULE 8

Regulation 28(1)(b)

CERTIFICATE OF IDENTIFICATION AS A SPECIALIST INSPECTOR

The bearer         , who is an employee of the         ,

and whose photograph and signature appear on this card, is a specialist inspector, appointed under section 18A of the Prevention of Cruelty to Animals Act 1986 and is authorised to exercise the powers of a specialist inspector under Part 2A and Part 3A of that Act.

8Substitution of regulation 33

For regulation 33 of the Prevention of Cruelty to Animals Regulations 1997 substitute

"33   Transitional provision

Despite the commencement of the Prevention of Cruelty to Animals (Amendment) Regulations 2008, an identification certificate issued to a POCTA inspector under section 19 of the Act and in force immediately before that commencement, that is in the form prescribed in these Regulations as in force immediately before that commencement, is to be taken to be an identification certificate in the prescribed form within the meaning of section 19 of the Act until the date of expiry of the certificate.".
