Transport (Passenger Vehicles) (Miscellaneous Amendment) Regulations 2008
The Administrator of the State of Victoria as the Governor's deputy with the advice of the Executive Council, makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Transport (Passenger Vehicles) Regulations 2005—
(a)to allow its automatic revocation under section 5 of the Subordinate Legislation Act 1994; and
(b)to amend the definition of omnibus; and
(c)to make it an offence for a person to leave or enter a moving vehicle.
2Authorising provisions
These Regulations are made under sections 162 and 256 of the Transport Act1983.
3Commencement
These Regulations come into operation on 29 June 2008.
4Definition of omnibus substituted
In regulation 4 of the Transport (Passenger Vehicles) Regulations 2005[1], for the definition of omnibus substitute—
"omnibus means a commercial passenger vehicle with a seating capacity of more than 9 persons, including the driver;".
5Entering or leaving a vehicle
After regulation 66(2) of the Transport (Passenger Vehicles) Regulations 2005 insert—
"(3)A person in or on a public commercial passenger vehicle or a public passenger vehicle operated for the purpose of a regular passenger service must not, without reasonable excuse, enter or leave or attempt to enter or leave the vehicle while the vehicle is in motion.
Penalty:10 penalty units.".
6Revocation of expiry
Regulation 75 of the Transport (Passenger Vehicles) Regulations 2005 is revoked.
