Transport (Conduct and Infringements) Amendment Regulations 2008

The Governor in Council makes the following Regulations:

1Objectives

The objectives of these Regulations are—

(a)to amend the Transport (Conduct) Regulations 2005 to amend the offence of failing to obey traffic control devices and parking control signs; and

(b)to amend the Transport (Infringements) Regulations 1999 to amend offence codes for touting and failing to obey traffic control devices and parking control signs.

2Authorising provisions

These Regulations are made under sections 56 and 215 of the Transport Act1983.

3Amendment of the Transport (Conduct) Regulations 2005

For regulation 36(2) of the Transport (Conduct) Regulations 2005[1], substitute—

"(2)A person who drives or rides a vehicle on rail premises must obey all parking control signs displayed or erected on the premises.

Penalty:10 penalty units.

(2A)A person who drives or rides a vehicle on rail premises must obey all traffic control devices displayed or erected on the premises.

Penalty:10 penalty units.".

4Transport Infringements—Schedule 3 to the Transport (Infringements) Regulations 1999

(1)In the Table in Schedule 3 to the Transport (Infringements) Regulations 1999[2], under the heading "General Conduct Affecting Safety" for the item relating to code 3175 substitute—

"reg. 36(2A) Failing to obey traffic control devices on rail premises 1·47 3175".

(2)In the Table in Schedule 3 to the Transport (Infringements) Regulations 1999, under the heading "General Conduct Affecting Safety" for the item relating to code 3173 substitute—

"reg. 36(2) Failing to obey parking control signs on rail premises 0·5 2487".

(3)In the Table in Schedule 3 to the Transport (Infringements) Regulations 1999, under the heading "Passenger Vehicles", in column 4 of the item relating to section 158A(2), for "2485" substitute "2486".
