Trade Measurement Amendment (Standard Wine Package Marking) Regulations 2008
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Trade Measurement Regulations 2007 to adopt nationally agreed reforms to the model Uniform Trade Measurement Legislation for measurement marking on a standard wine package.
2Authorising provisions
These Regulations are made under section 80 of the Trade Measurement Act 1995 and section 25 of the Trade Measurement (Administration) Act 1995.
3Definitions
(1)In regulation 4 of the Trade Measurement Regulations 2007[1], in the definition of tobacco, for "tobacco." substitute "tobacco;".
(2)In regulation 4 of the Trade Measurement Regulations 2007 insert the following definitions—
"standard wine package means a package containing—
(a)50 ml, 100 ml, 187 ml, 200 ml, 250 ml, 375 ml, 500 ml, 750 ml, 1 L or 1.5 L of wine; or
(b)2 or more whole litres of wine;
wine means a beverage—
(a)produced by the complete or partial alcoholic fermentation of fresh grapes, grape must or other products derived from fresh grapes; and
(b)containing not less than 7% and not more than 24% of alcohol by volume.".
4Requirements for measurement marking on standard wine packages
(1)After regulation 62(2)(a) of the Trade Measurement Regulations 2007 insert—
"(ab)a standard wine package if the measurement marking on the package complies with regulation 62A; or".
(2)After regulation 62 of the Trade Measurement Regulations 2007 insert—
"62A Position of measurement marking on a standard wine package
(1)For the purposes of regulation 62(2)(ab), the measurement marking on a standard wine package must be made on the surface of the package, other than the base or the top, in a way that enables all of the following information about the wine to be seen in a single field of vision—
(a)the statement of the measurement; and
(b)the country of origin; and
(c)the product name or product description; and
(d)the actual alcohol content by volume in percentage terms.
(2)For the purposes of subregulation (1), information on a standard wine package can be seen in a single field of vision if a person can see the information without having to turn the package.".
