Road Safety (Road Rules) Amendment (Traffic Control Items) Regulations 2008

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Road Safety (Road Rules) Regulations 1999 to resolve inconsistencies between major traffic control items and minor traffic control items.

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Power of Councils to erect traffic control items and signs for the purpose of traffic regulation

At the end of regulation 304 of the Road Safety (Road Rules) Regulations 1999[1] insert

"(2)Despite subregulation (1), a Council must not erect, establish, display or maintain a minor traffic control item referred to in subregulation (1)(a) that is inconsistent with a major traffic control item located on the same length of road.

(3)If a minor traffic control item referred to in subregulation (1)(a) is inconsistent with a major traffic control item located on the same length of road, the relevant Council must—

(a)alter the minor traffic control item to remove the inconsistency; or

(b)remove the minor traffic control item.".
