Residential Tenancies Act 1997
Residential Tenancies Amendment (Prescribed Tenancy Agreements) Regulations 2009
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to amend the Residential Tenancies Regulations 2008 to prescribe certain tenancy agreements to be prescribed agreements.
2Authorising provisions
These Regulations are made under sections 14 and 511 of the Residential Tenancies Act 1997.
3Commencement
These Regulations come into operation on 18 February 2009.
4New regulation 5A inserted
After regulation 5 of the Residential Tenancies Regulations 2008[1] insert—
"5A Prescribed tenancy agreements
For the purposes of section 14(2) of the Act, a tenancy agreement is a prescribed agreement if—
(a) the landlord is the Director of Housing; and
(b) the tenancy agreement arises because the tenant was directly affected by the bushfires that occurred in Victoria in January 2009 or February 2009.".
