Road Safety (General) and Road Safety (Road Rules) Amendment (Seatbelts) Regulations 2009
The Governor in Council makes the following Regulations:

1Objective
The objective of these Regulations is to—
(a)amend the Road Safety (General) Regulations 1999 to provide for new offence codes and descriptions for the seatbelt offences in the Road Rules;
(b)amend the Road Safety (Road Rules) Regulations 1999 to clarify the seatbelt offences in rules 265 and 266 of the Road Rules.
2Authorising provision
These Regulations are made under section 95 of the Road Safety Act 1986.
3Amendments to Schedule 4 to Road Safety (General) Regulations 1999
(1)In Schedule 4 to the Road Safety (General) Regulations 1999[1], the items relating to codes 2081 and 2082 are revoked.
(2)In Schedule 4 to the Road Safety (General) Regulations 1999, after the item relating to code 2545, insert—

1·35 penalty units
7386 Passenger under 16 not restrained RR 266(1) 1·65 penalty units 7387 Passenger under 16 occupying same seating position as another passenger RR 266(1) 1·65 penalty units". 4Amendments to Schedule 4 to Road Safety (Road Rules) Regulations 1999
(1)For item 37 of Schedule 4 to the Road Safety (Road Rules) Regulations 1999[2], substitute—
'37.Rule 265 of the Road Rules is to be read as if there were substituted for rules 265(2), (3) and (4)—
"(2)Unless the passenger is exempt from wearing a seatbelt under rule 267, the passenger must—
(a)occupy a seating position fitted with a seatbelt; and
(b)wear the seatbelt properly adjusted and fastened.
(3)The passenger must not occupy the same seating position as another passenger.".'.
(2)In item 39 of Schedule 4 to the Road Safety (Road Rules) Regulations 1999, for "rule 266(6)(b)" substitute "rules 266(4) and 266(6)(b)".
